1. If a PR fails 2 maintain 2/5 years residense in Canada does he loose his PR status ?? Are there exceptions ??
2. Assuming that the person loses his PR status - is such a person eligible to reapply for Immigration and if yes would his earlier PR status go in his favor or against his new application ?

1. You won't automatically lose your PR. There will be a determination of loss of PR and you can appeal [in Canada] within 60 days of being notified of the determination. Your lawyer will then advise you on the strength/weaknesses of your case.
Exceptions are:
a) if you are outside Canada but employed by a Canadian company or governmental department;
b) if you are accompanying your Canadian spouse outside Canada

When will such a determination be made ..... as soon as it occurs or as late as it is required . For instance a new Immigrant lands in Canada and doesnt return till 3.5 years . Technically he cant live for 2/5 years now. So when is it most likely for this determination 2 b made --- after the 3rd year itself or in the 4th or 5 th year .
As per point no. 2 above --- in the worst scenario if he loses his PR status --- is he eligible to apply again as an Immigrant and in this case his earlier PR status wil be advantageous or disadvantageous ??

It can be made at different stages. ... but most probably when/if an officer asks you "WHEN DID YOU LEAVE CANADA?" when you are trying to re-enter Canada.
You will be allowed in temporarily.
WORSE SCENARIO: No negative offect on future fresh application.

1 last q -- in case a person re enters 06 months late (after 3.5 years) and the reason is his own sickness or any family member s sickness what are the chances he has of his PR status not being lost when determined .
