help needed on decision made by high commision on travel document

I was became PR of canada in june,2009 went twice to canada. Last I went dec 2013 stayed there for about 120 days i.e upto apr'2014. Due my health problem I came back to india. In mean time due some other circumstances I did not not go back to canada till mar'2015. My PR got expired in may'2014 and I tried for Travel Document for going back to canada. After waiting for 2 months I got reply that I did not meet residency obligation so my PR status is no loger valid and I am advice to apply for appeal to the Immigration Appeal Division of the immigration and refugee board. Most important thing is they have also endorsed Travel Document as Permanent resident on my passport with the validity upto nov 2015. Now I am confuse whether I am allowed to travel on that visa or not

You landed here and got PR status in June 2009. The status needs to be renewed at the end of May 2014, which you could not do, as you could not complete the required 730 days in the first FIVE Years.

Now you know that you LOST your PR Status too.

They are now advising you to appeal their decision. The procedure to do such an appeal is ONLY through a Lawyer. We can provide you with a link to a few of them. To process such an appeal will be a long drawn and expensive one too. Also it could be done only on Humanitarian grounds. This you can do by providing the lawyer with all of the details of your case and the situation that you were in, to the lawyer to pursue such an appeal.

Though the extension of such a visa that you have in your Passport might permit you to travel towards Canada, the Immigration officer can still refuse entry to you at the Port of Entry, based upon the facts of the case.

So, prior to booking a ticket, you should speak with a lawyer and also get a letter from him stating that he will accept you as a client and has appealed their decision on your behalf and you also have a copy of such a correspondence on person, prior to booking the seat. Also, please get his 24 hour contact number so that he can appear for you at the airport to bail you out, in case you need his services in an emergency or if you are detained by the CBSA at their check point.

for your information in my case senario is some thing diffirent. I have my complete family son/daughters in canada and they are citizen of canada. My objective is not to appeal for decission simply go on this document and stay for next 2 year to get PR renewed

By what you are saying, it looks like they are allowing you to be let inside Canada.
They will not jail you but you will have to file your appeal at the appropriate authority in Canada (Immigration Canada will advise you). They will let you stay in Canada as long as the order is in process. If the order is accepted, they will let you stay or if not, you will have to leave.

There are ways (which your lawyer will tell you) where your case will be accepted. You will have to tell pathetic family / sickness stories in front of the judge and you will also have to cry infront of the judge that you will be missing your family, if he does not grant you permission to stay within Canada. Just like food banks, this is another area where exploitation of the goodness of Canada exists.

Again, I am not providing legal advise. Please check other forums or with a lawyer.

PLEASE CONSULT A LAWYER FOR YOUR OWN GOOD. REASON BEING...that there is a refusal of a travel document to return to Canada, has been lodged there in your files.. The Immigration Officer has been nice to extend to you such a visa to return back.

You can surely do the required completion, as suggested by you. If that is all that is required, then they will let you renew your PR card too. If you are stuck at that stage, you will have to go through the APPEAL Process. Hence the suggestion that you meet and talk with a lawyer.

Although the Visa will let you get you in upto the CBSA check point, you will have to stay behind at the CBSA secondary inspection and provide all of the details for your inability to complete the required 730 days. If a lawyer will provide you with his advice, as they handle such matters from time to time to get others out of a situation like the one you are in, if you get such an advice, you will be better equipped to provide them the correct details, than pour out your troubled past, which might help or might not help.

So, do not complicate your case and the entry into Canada. The few bucks that you will have to shell out now will protect your case and your deriere, just in time.

what will happen if do not appeal and stay back to complete my 730 days. Also I have another option to go canada is super visa which can be processed through my family over there. Going to canada is not the problem there many ways visitor,super etc. but I am interested to remain as PR
