hello all,

i want to apply for an immigration to Canada but confused about my work experience. as from the last six years, i've been working for an IT and Software company under a specific job title but with two different roles. one of them is on the list of 38 occupations, and the other one is not.

1. i'm not sure will i be eligible to apply in such a situation?
2. if yes, then how do i calculate my total eligible work experience? should i claim the maximum points for experience (because my total experience is 4 years plus) or should i only claim points for two or three years of an experience because i didn't work in that specific role on 100% basis?
3. do i need to request my employer to specifically mention the percentage of my involvement in each role so to let CIC calculate the eligible work experience?

speaking about all the job titles and example job titles on the list of 38 occupations, is this necessary to have a job title exactly one of those? what if someone's job title is Software Engineer or Mechanical Engineer but his main duties are the ones that are for "0213: Computer and Information Systems Managers". Or if someones job title in a company is Project Manager but his duties also include the ones for "4131: College and Other Vocational Instructors". I am only giving examples with job titles but main intention is to find out does the job title needs to me more or less the same as displayed on the list for 38 occupations and example titles included under each NOC code? Or is this only the job description and list of duties that should be more or less the same as given under the NOC code?

many thanks for your comments.

YES, it will be nice to have the job title as specified in the NOC numbers. But it must meet the job description.

You should get a letter of employment from your employer with the exact details. But if it is to your advantage to get it fit the job specifications that suit the NOC number and the employer can state you also handled other additional duties that you actually did on top of it. This way you can make the maximum mileage out of the job description and it is what you want. Then both of you should stick to it, if and when inquired about it, it should be the same as written in that letter. I hope you got it.

1) Now you are eligible to apply, because NOW you know you are.

2) The full time that you were employed with them as stated by your employer in his letter of employment. You both decide upon the dates. That will give you the number of years of experience.

3) You were only in one role as written by your employer in his letter of employment. AND it qualifies you for the job, description of which is as written in the NOC Description. Now get that straight.

Good Luck.

Now you can get an application and fill it in and pay the fees too.

Freddie.

thanks, this obviously looks like a more suitable approach. but i have a confusion and would like you to please advise.

last year my employer was transferring me to canada, we lodged the work permit application, did the medicals, but before the grant of work permit the employer cancelled my transfer because of global economic slow down. ultimately the work permit application was withdrawn.

now the question is;

1. i will have to inform CIC in my PR application that i applied for a work permit in the past and the application was withdrawn. after knowing this, do you think they will make a comparison of the documents (submitted with the work permit application) VS the documents (submitted with the PR application)? im concerned because if i submit my reference letter just like you advised in your previous post to make me eligible for skilled worker application, and they start comparing this reference letter with the one i submitted with my work permit application, that could create problems? because the one submitted with work permit application was reflecting both the roles just like i explained in my first post above. what do you think about this situation? do they compare the documents against any documents submitted to them in the past?

2. can the fact, that my work permit application was withdrawn, create any negative effect on my PR application?

regards

Humans might have lapse of memory. Files could go from one officer to the next. But what is stored in a computer stays and so, please, please stick to the one submitted.
Anything more I will get back to you.

Good Luck.

Freddie.

Edit: I will PM you shortly.
