Comments from an immigration consultant registered with CSIC

"Note that only 1 year of your experience must be in one of the 38 NOC codes, your other experience can be in any other skilled occupation (skill level 0, A or B) even if that is not on the list of 38 occupations. This way your other job will also count. e.g. 1 year of experience as IT Manager (which is on the list of 38 occupations) + 3 years of experience as Mechanical Engineer (which is not on the list of 38 occupations), you are eligible for maximum 21 points for experience."

I was under the impression that CIC considers and gives points for only the experience gained in one or more of the occupations that are on the list of 38 occupations. But the above person is saying that if you have one year of work experience in one of the occupations on the list and remaining three years of work experience is in an occupation which is not even on list, still the applicant would be eligible for the maximum 21 points for work experience.

any comments? is this the real case?

Here is my interpretation after reading between the lines., you MUST have at least one year's experience in ONE of the listed 38 NOC occupations and the balance if more than one ALSO, preferably in the one of the OTHER 38 NOC occupations listed here in. (The reason being that you will have the opportunity of moving YOU from one to the next if it ever calls for.) It will enable them to train you very easily and switch you over to the next, if circumstances demand.

Also it need not be in any of the listed in the other 37 NOC BUT it could also be in any of the other NOC (that are not listed) BUT at levels "O" "A" or"B". in the other NOC numbers. Which in my opinion will make you switchable even without the training. Which will save them the EI training. (cagey cagey)

They have provided you with the list of NOCs that they have opened to Immigrants, and it is my interpretation, since there is a demand for all of the other 37 makes the switching over in an easier manner. Most of the Immigrants HAS to fall into ONE of the 38. To fall into MORE than one listed will enable them to choose such an individual who qualifies in more than one. I am sure that they will give preference to them. (First)

If you do not qualify then they will refund the fee. Quotes.

If you can jump from limb to limb AND tree to tree, they will choose him/her. Please bring a few hats to go with it. You can switch hats.

Is it the real case? Please read the cic.gc.ca It is all there. If you see a ten dollar word in any of these publications, then there sure is a lawyer behind it.

thanks for clearing it up Freddie.

1. this gives me an impression that if all the 4 years of experience is from one or more of the occupations in list, this would be good. but even if 1 year is from an occupation in list and 3 years is not from the rest of 37 occupations in list, still the applicant has the chance to qualify for maximum 21 points, provided his remaining 3 years of experience is one of the skilled occupations (Skill level 0, A, or B).

2. what's the timeline (processing time) for the initial approval of the skilled worker applications from Sydney, Nova Scotia? i mean the time they take to inform you whether you qualify or not.

3. when they inform you that you qualify, do they also inform you (or give you an idea) about how many points for work experience you are eligible for? e.g. do they tell you that you have 2 years of eligible experience and you are eligible for 17 points. or you have 3 years of eligible experience and you are eligible for 19 points?

4. if the applicant is claiming experience in a specific code, and his application goes through successfully and at last he is able to reach canada as a skilled worker, is this necessary that he will have to do a job in that specific NOC code on the basis of which he lodged his application? e.g. if he falls under NOC code 4131 (trainers), his application is approved, he reaches canada. is the canadian government or CIC impose some condition on him that he will only do a job in canada under 4131? or do they check whether the applicant is really working under this code in Canada?

1) Generally you are qualified and have a profession. That qualification falls into one of the NOC class. Not many are qualified in more than one. So, you normally fall into one. So, all of the experience will be in that class. And if perchance you also have additional qualification and it is also in on of the the other 37, then it is O.K. too. It should be one year minimum in one of the NOC Number. And you qualify. Now for the scores, if you have more number of years experience in one, then you get more points.
One or two might have experience in one in NOC and also into another one outside of the 38, but also in another NOC not in the list 0f 38 and at a level O, A, or B then they also qualify. But my feeling is that they will get preference. You also know the reason.

2) What I hear is that they will give you an AOR and then take their own sweet time. It could be about SIX months to process. After that you will have to go through your medical and PCC, about six weeks to three months each. So time line is about an year plus. The new center is doing fast work. So, you can anticipate a faster response.

3) You can easily figure out the point count once they give a go ahead. I don't know if ECAS will give that or not. Check with the others please.

4) Once you are an Immigrant, all the avenues are open and you have a large horizon to look at. Hence NO restrictions in your job search for a suitable opening. When you qualify under one code, YOU will be looking for employers who are looking for people from that trade and with a lot of experience. Now your salary depends upon your experience. So, you will have to decide and the choice is yours. Some times they pay you a salary three times that in remote areas. But there is no life there. It is like a prison. You might become a nut case or you will retire soon with a lot of money. Get your Canadian Citizenship and hit the beaches or go to the foot hills of the Himalayas and become a hermit.

There is always a fork in the road and if your crystal ball is working, then use it. Some people can smell the money and take the right road. A few marry into it. Who knows you might win a lottery and every week we have a baker's dozen that get out of the work force. Why not you.!
