How do we go about this?
THe Canadian embassy in Abu Dhabi have asked for a number of documents BUT at the same time are asking to cancel the UAE visa (30 days max you can stay in dubai)
They also provide no assurance that the visa will be confirmed because of the additional documents requested...so based on the information they will decide.
Can they ask a person to resign from a job without approving all the paper work?
If God forbid they say they require additional information and the 30 day stay grace period runs out in Dubai, he will have to return to India jobless.
How do you proceed with this?

You have to be a little more clearer than this and provide us with a better picture of the process that you have gone through thus far.
Once again, I would urge you to read the letter a couple of times over. You might find that they will accept all of the documents and then provide you with a decision after review.
After a decision has been made and the Visa is issued to you, they would like you to depart within a period of thirty days of its issue. That is my inference from your submission to us here and without reading the letter that you have in front of you.
Are you a high ranking officer in the Government or in a financial institution?? Or may be you are posting this for a friend who is holding such a post?

Freddie,
We've gone through the standard spousal sponsorship where the sponsor is in the UAE along with the applicant. So all other documents and proof have been provided as requested.
They seem very stern and no compassion is show which I am very suprised as the AUD office is extremely rude to be dealing with a Canadian citizens like this on a number of other instances as well.
We now received the final request to submit the applicant's passport to stamp the Canadian visa, but also included in the letter it asks to send the following...
Quote
"- evidence of cancellation of the residence visas of your sponsor and you, your resignation from your employment in the UAE & payment of end-of-service benefits and transfer to Canada
- any other compelling evidence that your sponsor is planning to return to Canada permanently or has already done so.
Your passport is being returned to you without a Permanent Residence visa as you need it in order to accomplish the above.
If you or your sponsor are unwilling or unable to comply with the outlined conditions, please have your sponsor withdraw the undertaking."
So what is considered "compelling" evidence to return to Canada other than a house rental or going back to school?
It would make more sense if they requested all the documents and approve it before demanding a cancelled UAE residence visa so that we don't loose our only income. So help!
Absolutely frustrated with this.
And no am not in Govt. office or work for a financial institution.... am a regular Canadian stuck outside the country who chooses to live together with my spouse that won't allow my spouse to return with me to Canada

You being a Canadian and residing there in the M.E., they want to make sure that you will move prior to their issuing you with a spousal Visa for her PR. That is a pre requisite. Please see their website.
Looks like a sure thing in your case.
But what happens after the issue of the Visa, you decide to return? You make your deal with the employer for that?? Every one is trying to get back to where they were before entering into Canada, because of the current employment picture. Mmmmmm....
Good Luck.
Freddie.
The businesses everywhere are mean and lean. The stock market and Home constructions are slowly moving up. But the GDP has dropped so low, you can see the scuff marks on the drag. It is a rosy picture, but the Job losses are on the increase.
Here they say, recession is over, what they don't know is that "it is a dead cat bounce". The educated idiots see the world with rose coloured glasses. Reality ...is is a different story.

Thanks Freedie for the info.
What is the web site that you were referring to that states the visa will not be stamped until the sponsor return to Canada? I looked all over http://www.cic.gc.ca" rel="nofollow">LINK and nothing is listed under the FAQ.

Here are some of the safeguards that they have built up to cover themselves.

You have to make a commitment to them in writing saying that you will be here in Canada when she arrives. Please see the requisite forms and the ones that you signed when you applied.
Based upon that commitment that you have made, they want you to relinquish your stay at that end and move over to Canada first. Then they are saying that they will process that application. They are covering their A.
Also look into Box # 20 :
http://www.cic.gc.ca/english/pdf/kits/forms/IMM5491E.PDF
In your case they are enforcing it.
Hope this makes it clear for you.
