Hello

Iam a canadian citizen living In US.

MY wife is a PR she stayed in canada for 1yr and 3 months. ( she came to canada as a landed Immigrant in 2005 , we moved to US in 2006.)
Now her PR is expiring in apr 2010. we want to renew her PR ( she is staying with me from past 4 yrs ).

we want to apply for her PR renewal

will her PR be renewed .?

There's no point. she has already lost her PR.
she had to stay in Canada for at least 2 years during her first 5 years.
if she wants to maintain PR, her only option is to move back to Canada immediate and stay for at least 2 years so that she can maintain the 2/5 rule.

Time spent outside of Canada
You may also count the days spent outside of Canada in the following circumstances as days for which you satisfy the residency obligation:

OPTION 1. Accompanying a Canadian citizen outside Canada

You may count each day that you accompanied a Canadian citizen outside Canada provided that the person you accompanied is your

spouse or common-law partner or
parent, if you are less than 22 years of age
Evidence that you are accompanying a Canadian citizen
You must provide supporting documents to prove that:

The person you are accompanying is a Canadian citizen; and
You are the spouse, common-law partner or child of that person.
Supporting documents may include:

marriage licence
child’s birth certificate, baptismal document, and/or adoption or guardianship document
school and/or employment records
association or club memberships
passports or other travel documents
documents indicating the status of the person you are accompanying

I have few more queries reg the renewal ,

1.The question in IMM5444 ( Q12 & Q13.residential addresses in canada, mailing addresses in canada) as we r living here in US can i give my US addresss.

2.which case processing center i shd send the application ( we r in east coast of USA)

3. how long is the wait time for renewal in her case( as she will be applying under residency obligation staying with acanadian itizen spouse)

When you are outside Canada, you can maintain your PR status, not apply for a PR card. You can apply for a PR card once you come back to Canada. To enter Canada, you would need a travel document from the local CHC.

Check this.

If you are currently outside Canada and do not have a valid PR Card to return to Canada, you will need to obtain a travel document from a Canadian visa office. An application is available on our website.

Once you have returned to Canada, you should apply for a PR Card.

You are right but it stands true for people who do landing and return and wait for a later time to relocate. For them PR card is not needed and is needed when they permanently relocate.

We are PR's working for a Canadian company outside Canada and hold PR cards, we travel to Canada twice a year for vacation and immigration officers suggested us to work with PR cards and not to apply for Travel document each and every time we visit. It is not cost effective for a family of four. Since you are a Canadian citizen your wife can apply for PR and should also get a card. For card delivery you'll have to give a local Canadian address, we used our lawyer's address and it was delivered without problem.

In your case

1. Please check this with a lawyer or someone before you fill in this. I can only give you example from my personal case, we gave our residential address which is not in Canada but for card delivery we gave our lawyers address which is in Canada. Also note that my kids cards were not delivered to our lawyers office and we visited CIC office personally to collect them. If there's an option and you can take a trip to Canada, fill in for collecting it personally.

2. I'm not sure of the Embassy near you but the nearest should do.

3. It depends but should be between 3-6 months. We got our kids PR in 3 months.
