Hi Everyone,

I'm trying to renew my PR card. I came to Canada in 2003 and stayed there for about 11 months and then I moved to US with my wife (she is a Canadian citizen). Now my PR card is expiring in a month. I was in Canada few days back and I applied for renewal of PR card while I was there.

Since I did not live in Canada for 730 days, I selected the option of Canadian spouse accompanying me under residency obligation, while filling the PR Card renewal form.

For the proof I provided a copy of my wife’s passport and marriage certificate.

My question to experts is. Based on the above information do you think I would be able to renew my PR Card?

Right now I’m living in US with my wife and I don’t think I would get the PR Card renewed before my old card is expired. How can I go back to Canada to get my new card if my old card is expired?

Thanks very much in advance.

Here is a link to their PR renewal kit. You did go through the same and applied for renewal.
http://www.cic.gc.ca/english/pdf/kits/forms/IMM5574E.pdf
Page 2 : Under which, "1095 days or more", they have asked you for all of the details and you did submit the full requirements that is asked for. Correct.?
Now: Did you provide them with a Canadian Address to reply back to you?
Next question : Do you have intentions to return back here and stay and settle down? Or just passes through to apply for the card? Is there anyone who will mail the card or the information that will come to that address?

These are the crucial questions that need to be answered before you can get the correct answers.

If you do not get the possession of the Card that you applied for, then you will have to apply for a Travel Document the next time you want to enter. Here is the : http://www.cic.gc.ca/english/information/applications/travel.asp
They do not send the PR Card to an overseas location. You have to make your own arrangements to receive it here, within Canada. If it lacks any detail then they will respond to that address that is within Canada. You have to make arrangements to have it forwarded to you. Then you reply back through the Canadian Address, and by asking some one to mail it locally here in Canada to them.

Once that PR Card is received by your local contact, you ask them to send it to you by Secure Postal system to you for your use for the next five years. You carry the same on person every time you cross.

Hope this answers your question in detail.

Freddie.

Thanks a lot for your detailed reply. I really appreciate that.

Yes I completed the application kit and got it signed by a Guarantor (from Canada), provided a Canadian mailing address. but I mailed the application from USA and not within Canada. Do you think that may cause a problem?

On Page 2 I selected the 1 option i.e. 'If applicable, proof of your relationship to the Canadian Citizen you accompanied abroad and proof of his or her citizenship'

I sent a copy of my wife's first page of passport and our marriage certificate. is this enough?

I've some family members in Canada and they can forward me the mails etc.

I read somewhere that you have to personally receive the PR Card from govt agency and since right now I'm in USA and I don't think I'll get my card renewed before my current one expires. Do you think I would have any problem in getting Travel document since I've already applied for PR Card renewal?

I plan to return back to Canada in about 2 years because right now my wife is completing her college here.

You must have done a good filing of the renewal. There should be no other call for other materials. If some one is looking after the arrival of the mail or the Card in particular here, then you have covered all of the grounds.

The mailing locally here gives it a local authenticity. Since you needed your Passport for travels and you mailed it from USA they will understand why it came from there. They already know that you are in the States. How they handle such a case is left to the Officer who gets to handle YOUR Case.

There is no requirement that you personally present yourself, because those who are profitably employed do retain others to do the work for them. You can see that in the link also. So, you will soon know the out come. They have no qualms as you have Married a Canadian Citizen. You can come and go as you please. All you need is another application for a travel document and it is a breeze in your case. But I leave it to the better judgment of the officer. Not many can stay for that long a time to sojourn and collect.

The next time stay here and collect it. We pay more for any kind of Photo ID card and this one is the BEST of them all.

Freddie.

I was concerned about how does the officer checks the condition of 'Accompanying a Canadian citizen outside Canada'.

I found the following document at CIC website
http://www.cic.gc.ca/English/resources/manuals/enf/enf23e.pdf

This document says

In the case of a permanent resident outside Canada accompanying a Canadian citizen, it is not necessary to determine who is accompanying whom, nor is it necessary to determine for what purpose. In other words, under A28(2)(a)(ii) and R61(4), as long as a permanent resident is accompanying a Canadian citizen, the intent and purpose of their absences are not relevant as the residency obligation is met

I'm posting this so anyone who has similar doubts can check this document.

Thanks very much Freddie for your detailed replies. It really helped :)

Hi , I am in process to apply for my PR card renewal . When my PR card was issued they included part of my father's name in my name . I want to change it now and keep my name only . For example : my name is raman kumar , father's name is shantilal .. In my PR card they mentioned my name as : Raman kumar sha like that. Please guide me where I should request to change/correct my name ? Can I do it with my PR renewal application ?

Some of the errors could be done easily, without much fuss. You should go to the SERVICE ONTARIO nearby and ask how it could be done.

BUT FOR LEGAL NAME CHANGE...: Apply to legally change names in Ontario ..

Applications must be filed and the fee paid directly to Service Ontario. If your application is successful expect your amended birth certificate or legal name change certificate to be issued in 6-8 weeks. Once approved you must stop using your prior name immediately. It’s your responsibility to get all your identification and records updated into your new name as quickly as possible. You should get the name changed on your Ontario driver’s license and Canadian passport within 14 days. If you haven’t yet changed names you can download the application form below.

You can download the Application to Change an Adult’s Name, fill it out, then mail in the completed form and required documents to ServiceOntario at:

Office of the Registrar General
PO Box 3000

Thunder Bay, ON P7B 5W0

If you are unable to download the form, you can request to have the form mailed to you. Please contact ServiceOntario at 1-800-461-2156 or 416-325-8305.

There are local agencies, such as Legal Aid near by or go to a library and ask the HEAD Librarian how it could be accomplished. They might help. You also know how now.
