Hello
I Beacme PR in 2005 stayed in canada till 2006 ( total # of days =380) came to US with spouse ( canadian) n staying here on work visa. PR renewed for 1time.
Now my question is can i apply for my citizenship ?
Thank u
You need to stay 1095 days in Canada physically to apply for citizenship.
" citizenship is not for sale ............Immigration Minister.
Citizenship Applications where the 3-year residency has not been met
Residence in Canada is usually demonstrated by physically residing in the country but in certain cases a person need not have been physically present for the entire three-year period if they can demonstrate they maintained a substantial connection to Canada during their absence. For example, where a person has their family in Canada, their property in Canada, has paid their income tax in Canada, and has been traveling back to Canada on a regular basis, but has spent more than one year in four outside Canada, it may still be possible to apply for citizenship on the basis they have been “de facto” resident in Canada. In each case a Citizenship Judge will review all the facts and make a decision as to whether a person can be considered resident for purposes of their citizenship application even if they have not been physically present in Canada for the entire 3 years in 4.
How many days have you actually physically spent in Canada in the last 4 years? Where and how have you filed taxes over the last 4 years?
i stayed 380days in canada . No i didnt file any taxes thr, since iam here iam filing taxes here in US. But i travel alot to canada and US frequently. recently i renewed My PR without any problems.
Thank u.
if u apply for Citizenship under ur current 380 residency, it will take 3-4 years before u see a judge..
In most cases a Judge usually rejects applications that dont meet the residency requirements.. Only chance u have have is he accepts to grant u citizenship on Human and compassionate grounds..
If u are not planning to come back any time soon then u can take a chance..
hellocanada you have absolutely no basis for applying for citizenship. Just traveling to Canada doesn't qualify you for citizenship.
