Yes, the I140 must be approved first and your priority date must be current to apply for 485.

Hello Dimple2001,
Once I have approved I140, should I apply for I-485 under my wife`s country of birth? I mean Ethiopian priority date will come sooner than Indian one under cross chargebility. Is it correct?

Hello Dimple2001,
Finally, I have approved I-140. My priority date is June 5 2013 under EB3. Once my priority date becomes current, My lawyer will apply for Consular Processing since I am a commuter from Canada to USA everyday.
My question is can you estimate when my above PD will become current for EB3 ROW ?
Sorry, I have no idea when PD will become current. However, if you haven't before, follow trackitt.com where there's always intense discussion surrounding GC. You might pose or research your question there. You'll get better and current information.
There is also a tracker on that site where people have posted their processing status. That data will provide some form of indication of the movement of the PD.

Hello all,
I am in dilemma. My I-824 was approved on Jan 20 2015 for consular Processing. My I-140 was under EB-3 with Indian Born. I live in Canada and have H1b extended for another three years up to 2018.
My wife was Born in Ethiopia. I am waiting from NVC. I am the primary applicant. According to Feb 2015 Visa bulletin, my priority date(June 5 2013) becomes current if I consider my wife`s born country.
My I-824 was approved on my name only. Will NVC consider cross Charge ability in my case?
Please reply.
Hello Dimple 2001,
Please throw some lights on my case.
Thanks
