Hello. I slipped off the snow two days ago and got a shoulder injury. It has stopped me from going to work because i have been asked by the doctor not to drive and not to lift or push weights which i am supposed to do quite often during my work. I live in an apartment building and slipped in the open parking area within the premises of the building. Can i sue the landlord on not clearing the area and sprinkling the brine / salt. Please suggest. Thanks

You should have contacted a lawyer straight away. They would have sent you to their Doctor to take tests and prepare the paper work.
Anyways, it is not too late. Contact a lawyer (a one that says that he will take fee only if you are sucessful and the fee will be taken from your settlement money). The names of lawyers can be got from leading free dailys.

Thanks TK, i will try to look into it. Actually the building supervisor has been so kind to us, even didnt charge the parking fee for last 6 months. just thinking how she would feel if i take such an action against them, honestly dont feel like going to that extent. but atleast i know the law because of you guys. thanks and have a wonderful year ahead, happy new year

Generally these apartment are held by rich Gora's or Jews. The supervisor is a person just like you and me on a fixed salary and rent free accomodation. He/she is supposed to clean the snow but may be was lethargic.
What would have happened if you fell and fractured your skull (I have also slipped many time- but never got hurt too much)?
Even if you donot Sue, please instruct the supervisor to be more deligent in the future.

You have a limited time, something like a year or so in which you can sue. It will most likely be settled by company in charge of clearing the snow for your building.
You will be incurring costs in way of loss of income, later may be physiotherapy, etc. It is your call to sue or not.
At the very minimum, you should have informed your building supervisor and manager of the incident. They should be documenting it.

You are right tk, actually it was just the beginning of very first fall and you cant expect salt/brine to be sprinkled at the same moment. Just wonder how strong a case of such individual could be to sue the landlord, who falls immediately after the first snow of the season starts falling. i mean you need some time to sprinkle salt / or clear the snow, shouldn't that little allowance be given to the landlord, what do you say !
