OCI - marriage certificate notarized affidavit

Hi All,
I am in the process of applying for OCI for my son (and had recently gone through converting our PIO to OCI - application in progress) and have a question regarding marriage certificate attestation requirements:

1) We have Canadian marriage certificate as we got married in Canada and had registered that. Do we still need notarized joint affidavit ? If not, should I self Attest the photocopies.

2) Isn't the affidavit usually require in case we don't have a corresponding official document ? So I am not sure why would they need notarized affidavit ?

We called the call center, they didn't even know about notarized affidavit and were giving random answers.

Any help will be appreciated.

This is from BSL OCI Checklist:

Marriage Certificate of parents; only if spouse?s name is not mentioned in either of parent?s Indian passports, then their marriage
certificate issued by the competent government authority is required. If Parents do not have marriage certificate attested by Ministry of
External Affairs New Delhi, then it can be accepted along with notarized joint affidavit with joint photograph from notary public or lawyer
in Canada

Indian Government is Indian. BLS is an Agent. They both are taking into consideration that the APPLICANTS are Inidans and settled abroad. With that as the starting point....

If you have/had an Indian Passport and the spouse's name is mentioned there in, they will take it as a proof of the Marriage and you both are 'Man and Wife.'

Alternately, A Marriage Certificate attested by the Ministry of External Affairs, New Delhi will do. If you are submitting a copy, then, get that copy NOTARIZED.

OR If you do not have the ONE ABOVE, then A NOTARIZED joint affidavit with a photograph of each one of you, once again it could be a Lawyer or a JP here in Canada.
(I have given a link to a form some time back here in CD for the similar question.)

Now to a simple solution: You got married here in Canada. You have the Canadian Marriage Certificate. Get a few copies and get them notarized and submit ONE. DONE.

I am leaving the other points that you have brought in here to make it simple.

You NOTARIZE a COPY. The J.P. will state that it is a true copy of the ORIGINAL.

Affidavit IS A SWORN Statement made in front of a JP or a Lawyer, (Paying his fees) in this case by BOTH of you, may be with Photographs and signatures alongside, and all of you sign and He puts his seal of Office. This is pasted onto a proforma application form.(In simple English, pasted onto a cheap home made form.){This happens when you don't have a Marriage Certificate. you may have a wedding invitation, a few photographs as proof to show him also, or a Video too.} fh

Sorry to confuse you further. It does not make any sense to me that any Indian government authority can validate a Canadian document. They can validate/attest an Indian document and I think that is what they are talking about. They are assuming you got married in India.

You may have to visit the BLS in person. When you go there, they will make you wait and the counter person will contact their supervisor and so on.

Take this above form (Joint Affidavit ) with you in addition to your Canadian Marriage Certificate.
Make sure the photograph is Joint, most Indian studios know, how to take this photo. It should not be 2 individual photos stuck together, but one joint photo of the two. Around 15 bucks for this Joint photo.
Ask the notary or lawyer to stamp a seal on it, half on the photo and half outside, very important. And also sign it. Most will do this for 20 bucks. Take 2 photo ids with you and your marriage certificate, when you go to the lawyer and this filled Joint Affidavit. They will just look at it and stamp it in few seconds.
You fill or type the form yourself, the lawyer or notary won't do it. They will just stamp the seal. Your name and spouse name should be exactly as entered on the passport and on the Joint Affidavit.

If you Try to save this 15 + 20 = 35 bucks, they will ask you to make a return trip or to get your Canadian Marriage Certificate attested by MEA, India, which is far worse than this Joint Affidavit.

If your Indian passport just has " Cancelled " stamp on it they are apparently asking for a Surrender certificate on top of it. Just a revenue generator. But double check with the embassy & BSL. Some people can and will get away with just a "Cancelled"

But if your Indian passport has " "Cancelled as holder acquired Foreign (or CDN) citizenship" stamp on it, you don't need a surrender certificate. Yes Surrender Certificate is a separate document. Just an A4 size white ordinary paper on which they type passport cancelled, your name, your passport number.

This is from CGI - Toronto :

Surrender Certificate/Renunciation Certificate for Indian Citizenship - Surrender certificate renouncing Indian citizenship on "acquisition of foreign citizenship". In case cancelled Indian passport bears the stamp "Cancelled on account of holder voluntarily acquiring Canadian citizenship?, then there is no need of separate Surrender Certificate.
