OCI Application - Marriage Certificate Affidavit Question

This may have been asked before, but could not find anything on CD. Also called BLS, but their answers are confusing and sometimes contradictory. So hoping someone has had the same experience before.

I have some questions related to marriage certificate requirement for an OCI application. The application form states that if the marriage certificate (for a marriage in India) is not attested by MEA in Delhi, then an alternative would be to provide "notarized joint affidavit with joint photograph and signatures from notary public or lawyer in Canada".

Can't seem to find any sample of what the affidavit looks like and nothing specified about the "joint photograph" format either. Has anyone provided this and can you please advise?

1. What is the format of this affidavit - does anyone have a sample they have used? This is to back up a non-attested marriage certificate from India per above requirement?
2. What is the "joint photograph" format? I'm assuming this needs to show the spouses in a single photograph but what size should it be?

This is the affidavit used - please format it. I have no idea about the joint photograph. Seems like a joint photo of both - you may double the size of passport photo - just a wild guess.

AFFIDAVIT

HUSBAND, son of Mr. XXXXXXX & Mrs xxxxxxxxxxx, resident of xxxxxxxxxxxxxxxxxx, first party
and
WIFE, daughter of Mr. XXXXXXX & Mrs xxxxxxxxxxx, resident of xxxxxxxxxxxxxxxxxx, second party.
That the above parties married by Hindu Rites on …..DATE….. The marriage was solemnized in presence of a large number of relatives, friends and Hindu Priests etc.
Both the parties have been living a happy married life with honesty and affection towards each other and in the cause of this marriage, they have two children as under:
1. xxxxxxxxxx DOB - ……date….
2. xxxxxxxxxx DOB - ……date….
Now a legal marriage certificate is being drawn which may be necessary in future even though both the parties have been married to each other since …..date of marriage….. The agreement as under is with full consent of both parties who are mature, educated and understand their interest.
1. That both the parties will continue to live in harmony as husband and wife as they have been living since ………date of marriage…...
2. That the first party’s immovable and movable property shall be inherited by the second party and their children.
We both the above named parties do hereby verify that the above contents of this agreement is/are true and correct to the best of our knowledge and belief. Nothing mentioned is false or concealed. No fact has been concealed. Verified this the …..day of …….., 2012 at the premises of ………………………….

Hello BL,

two weeks ago when i was at BLS - Brampton to submit OCI application for my son. we met one person who had same issue like you and person told me that Lady at BLS won't accept application because on Affidavit there was no photograph for both.

I remembered when my parents applied for marriage certificate that time they need photograph together...means wide photo shows couple in photo. you can try for photo at print to go at Mississauga or other location...

make sure when you do notary ask lawyer to certify photos as well..mean ask lawyer to make half stamp on photo and half on paper and sign to make more authentic..

all the best....Make sure do not forgot to put Red seal on paper because BLS have there on technology and for silly mistake they won't accept your application.

The rest is for your information. If you can use it, then please amend the form to suit your requirements.

(2)There were a few wedding planners that I had met at the Chamber of commerce under the CN Tower and they had all kinds of stationery with room for two pictures (I think they were 2 x 2 size) for identity and room for their signatures. You might still be able to get them from any Christian Supply Stores or from a wedding planner.

The last one I saw was a License that said 'Weekend marriage License' ay the Niagara Falls for a buck or more and we had a laugh at it. I am sure it is the best seller there.

For any Hindu Marriage performed between two Hindus it can be registered under section 8 of the Hindu Marriage Act, 1955. You require at least one or two photographs of this marriage ceremony, passport size photographs of both of you & witnesses and this may be optional depending upon the location. (It varies from place to place), if you have wedding card of this marriage or certificate issued by the priest or the temple where it took place, two witnesses of this marriage (any relatives of either side are best witnesses), both your birth certificate (passport, school leaving certificate, voter id card) & proof of your residence (passport, ration card, voters id card, rent agreement, telephone bill, electricity bill,driving license), just take these, and application along with affidavits of both of you along that of two witnesses of this marriage, for the registration in the office of the Marriage Registrar who is usually the Tahsildar of the District were you reside. This registration will be done on the same day on the basis of all these documents & the marriage certificate will be issued to you regarding this marriage which you can use for your visa/immigration/passport/legal purpose. (See Below)

{In case you want to get this marriage registered under the Special Marriage Act, 1954 if you are married by any form of religious marriage, this registration will take place after one months notice & in presence of three witnesses. This is brief regarding the marriage registration. All the necessary papers, affidavit, forms etc can be got typed by any typist sitting outside any district court/registrar office, affidavits can be attested by the notary public with his stamp.}
