During the processing of PR application for Canada, I got a job offer as "Analyst Programmer" from USA company who sponsored me for H1B. In Oct 2001 I went to take H1b Visa at the American Consulate in Mumbai.
But the officer decided to revoke my H1B petition stating that "he was not convinced that my background, experinece or specific knowledge were sufficient to satisfy the proposed job requirements. Therefore the petition along with original notice of action and other related douments are being returned to the INS with a recommendation that it be revoked. At this time the office is unable to answer any further questions regarding the status of the case and in order to obtain information about the petition contact the INS service center."
Now currently when i visited the site of INS it still shows my status.
The query is
1) I received interview call for Canada Skilled Worker PR Application and also asked to bring the filled form of background declaration in which the question is:
Have you, or, if you are the principal applicant, any of your family members listed in your application for permanent residence in Canada ever.
@ been refused admission to, or ordered to leave Canada or any other country? Yes / No
Could you guide me on the following whether I should reveal the fact or not.
Will it effect adversely as in my Canada PR application also I have stated NOC 2163 (Computer Programmer).
Your advice will be highly appreciated.
Regards,
Fcm.
There is no need to mention, I feel. After getting the Visa, if you were denied admission in the port of entry, it makes sense.Visa refusal is not Denial of admission. My friend was in a similar situation.Visa refusal is common in US Embassies. So, Dont worry. If and when asked, you can always say, you did not get the visa.I dont think, you were refused admission into the country.
Best of Luck!
Has it been mentioned or stamped in your passport that your Visa is denied or something to that effect? If you are so much worried, try to get a new passport by renewing your old passport.
Ofcourse, this is not a legal advice, but I am writing out of experience.
