Can one have US and Canadian Green Card at the same time ?

Hi ,

Is it possible to have a US Greencard (from marraige) , after being a Canadian PR and already completing Residency Obligation ie; 2 years out fo 5 year period.

Yes, but in the long-term, you may find it difficult to meet residency obligations in both countries.
You will have to do some juggling with your time to meet both countries' requirements, and I'm not sure whether it is even possible or not.
Most people end up choosing one over the other because it is not worthwhile.

As far as I am know, US GC does not really have any particular residency requirement except that you have to be physically in USA atleast once every year - may be just for a day. Therefore there is no juggling required really.

Infact you can have other PRs too. My boss used to be a PR of Thailand, Singapore , Indonesia and a citizen of India. Even today I have an ex-colleauge who is simultaneously PR of Singapore, Canada, Australia and New Zealand and citizenship of India at present.

Why would anybody want to be a permanent resident of sooo many countries is beyond me !

Anyhow, in the case of the United states, if you become a resident of some other country after acquiring a Green Card, you are deemed to have "abandoned" your US residency and lose your green card.

So if one is a GC holder and then acquires a Canadian PR (for example) and then comples the Canadian landing process, he/she is in effect abandoning the US residency.

Similarly, if one is a PR of Canada and acquires the permanent residency of another country (US or whatever), he/she would lose the landed immigrant status of Canada.
The simple act of *applying* for US residency will not cause the person to lose PR, but accepting the US green card and entering the US as a GC holder will cause the person to lose Canadian PR.

Whichever way you look, you have to choose between one or the other.
A person who is currently a PR holder and accepts a US GC is losing the PR status, and vice versa.

You can of course continue to live in Canada, but sooner or later, you will have to choose one or the other.

This statement is not really true.One of my friend just got US GC(By Executive category though).He will be applying for Canadian citizenship in July 2005 and then planning to move to US.Then he'll be able to get Canadian citizenship and stay in US .

your friend has done it throught the back door.

one cannot have both
pr's at the same time.


as for the person who got PR of Singapore, Indonesia etc, it seems his goal is not to build a solid resume but a pile of papers

dan is correct - your friend has simply skimped the laws.
A person forfeits Canadian LI status when he/she becomes the permanent resident of another country.

It is perfectly legal to be a citizen of multiple countries, but not PRs of multiple countries.

The only reason people are able to do so is because of the lack of enforcement, which is due to the lack of information sharing between countries.
Canada cannot possibly know if a Canadian PR becomes a permanent resident of, say, New Zealand because of a lack of information sharing.
