Hi,
I have landed in 2003 october and I am finishing-up my 3 years in the coming weeks. I work in US and staying in windsor,ON. When i landed, I started living in Canada with my wife and later in 2004 my wife was pregnant and we had no help at windsor because i go to work in the morning comes back in the late night. I started taking my wife to US to my brother's place and come back to windsor in the evening. someday's i stayed at my brother's place at michigan. My wife delivered the baby in michigan in 2004. I would say we were on and off in 2004 then we started living continuosly at windsor from end of 2004. I have my car, i crossed and crossing the border everyday, I have my H1B stamping from Toronto, I have all the bills, bank accounts, credicards, car payment, car insurance, phone number etc from end of 2004.
In this situation, Please help me with my questions.
1. Will they say anything because my kid born in US?
2. Can I go for citizenship without my wife and kid?
3. I am getting my US greencard soon, but I love to live in Canada since we have good friends and everything here in windsor now. will they consider that?
4. if they say that I have to live longer to prove my residency requirement, how long will it be?
Have anyone in this situation before? I would really appreciate any help on this. Thank you in advance.
1. Will they say anything because my kid born in US?
>>>>>>> NO. You state that you were living continuously since 2004. Where was your child? With you or in the US? If with you in Windsor, I am assuming your child is now a PR of Canada based on you sponsoring? If the child is a PR, who cares where the child was born? Don't have to post answers in this forum, however, just some things what others in the forum might wonder based on what you wrote.
2. Can I go for citizenship without my wife and kid?
>>>>>>> YES, for yourself. You cannot go on behalf of your wife, however.
3. I am getting my US greencard soon, but I love to live in Canada since we have good friends and everything here in windsor now. will they consider that?
>>>>>> Your question is not clear. As long as you have fulfilled the residency requirements, there is nothing to worry about even if you have taken extended trips outside of Canada.
4. if they say that I have to live longer to prove my residency requirement, how long will it be?
>>>>>>> You should know how much longer you need to live based on your absences.
Note that being absent from Canada few days here and there is perfectly ok. Everybody's got things to take care. What they normally look for is if you have fulfilled the residency requirements. If you have, you are ok.

Dimple, thank you so much for your time and help. I have one question, that do they ask for all the bills like utility, credit card, bank statement and other things?? because I have all kind of bills available from 2005 and 2006 but 2004 i did not keep it in order. I am missing lots of bills. How important that these bills/invoices are??
Basically how do they assess that you lived in Canada? Because there are no passport entry when cross the border? What if somebody live in US and claims that he lilved in CA? I am genuine so i have all the bills and there are lots of transactions and i have CA car. Its just genuine question I got.
Thanks for your help again.
Don't worry . If CIC needs the residency proofs records they will ask for it and also give you a list of things they need. This is called residency questionaire .
Sit back and relax. They will ask for what they need if required
