Hi All

I am a practicing advocate (LL.B.) since 31.5.2005 and have audiences before various tribunals, commissions, trial court and also the high court. I am presently working as an attorney in an LPO and mostly my job profile relates to a paralegal. This is to extend on my resume as the LPO deals in US laws. I also plan to sit for the Solicitor of England and Wales Exam , Cyber Forensics course and ISO certification course in the future.

My wife is a practicing Physiotherapist (B.Pth.) since the past 2 years and recently she has got the much coveted position of working as a Consultant in a widely recognized University of India. Rather, this is the first employment of such a type in this University since its inception about 75 years ago. We got married in Jan. 2007.

Considering the above, my queries are:

1. Who should file for a PR under the Skilled Worker Visa Regime, me or my wife? Although I understand that both of us would have to get an accreditation of our professional degrees done from the respective regulatory bodies, but considering the 67 point system, should a Lawyer apply as a Principal Applicant or a Physiotherapist?

2. How soon is the PR if filed from India and in case there is any infirmity in the application filing and the appplication is sent back to the principal applicant, would the process start all over again for the resubmitted application?

3. Which is the best place in Canada to set up the respective practices in Law and Physiotherapy?

4. Initially at the start of my profession, I was with a senior for 1 year who did not pay me at all ( as is the usual custom in India) and of couse, there was no contract of employment between him and me also. Then, how can the National Committee on Accredition be convinced that he was my employer as I was working under his tutelege.

5. Does an experience in self employment count toward work experience for PR purposes in Canada?

These are the mose fundamental queries I have. Please take time out to study and answer them.:cheers:

First of all, I would like you to visit official website by Canadian immigration authority that is:

-In that website you can check your point score and find out how many points you will get and how many your wife can //
-AFAIK, rightnow it is taking 5 to 6 for completion of process( rightnow they are processing 2002-03)
-It can be difficult to say that what place would be best after 6 years from now..

In continuation to my first mail, I submit that each time I conduct the online Skilled Worker Visa test, both me and my wife exceed the compulsary limit of 67 points.

So, considering the above, who should file the application as a principal applicant?

Does it matter by how many points does one exceed the 67 points regime?

How is the greater Toronto region for immigrating practicing Lawyer and a Physiotherapist?

When a infirm application is sent back to the applicant for resubmitting the same, how much time does it actually take? Does the entire process start all over again? If in India, an application is considered in 5 - 6 years, and upon considertaion it is found to be infirm and resubmitted, would it take 5-6 years again for it be be considered again? I mean, then a skilled visa PR would actually take 10 - 12 years to materialize, and then again, upon entry to Canada, the visa can again be refused by the immigration authorities on one ground or the other !

Does a period of self employment count towards work experience for skilled worker PR?

What if a person is in employment during the beginning of his profession but does not get paid by his employer or senior? Would the senior even then give a certificate to show the incumbency of the applicant in his office, in the absence of a contract of employment? This is very common among the Lawyers during tyhe start of their profession !

I went through the said link as suggested by you, but find your opinions more beneficial and precise.

I think you should be aware that since both of these professions are regulated, you will need credential evaluation and need to write exams, etc., before you can practice your profession in Canada.

I'm not an expert but as far as i know once you achieve over 67 it doesnt really matter, so you or your wife can apply

as rajanand said, you need to pass the exams once you pass you have great opprtunities here.

once they sent back for some reason or rejection then you will have to start that process all over again means same time limit as others but i believe if you are eligible to get 67 then they won't send your application back

all you need is proof that you worked and got paid for it, if you havent got paid then it will count as volunteer experience and then I'm afraid that they will count points for that certain period

Hi All,

Its feels gr8 to have a fraternity around.Thanx for all ur help and support guys.
I feel good that at least u guys actually know what u are talking about.
However, I had a query.

Is there any Canadian Govt. body or agency whom one can personally go to get his documents checked before submitting them to the High Commission, discuss about the immigration process, both generally & specifically and visit periodically to know the latest in Canada i.e akin to British Council of UK in all major cities.

Is there an anticipation in change/ increase in the 67 point system? What does the grapevine say?
