Termination of Tenancy Agreement

Hi Folks,

Couple of questions, I intend to terminate my tenancy agreement (currently on a month to month basis), is there is a formal notice format that I should be using or just write a note to the building management ? Also should I be paying last months rent (and claim deposit) or this is usually paid out of the deposit that we have with the building management ?

Before few months I raised concern about tenancy termination on the forum. I referred to this site that time http://www.ltb.gov.on.ca/en/index.html you will find all kind of forms there. I printed a form from this website; however, the superintendent of the rental unit said they don’t need this form and just need a signature on their own form (totally different from the official notice).

Even though you're on a month-2-month, you still need to give notice. Some ask for 2 months while others ask for 1 month, and that too calendar months. Check with the management office, and check your lease conditions.

1. Remember, you will generally need to give them 60 days notice. So if you give notice by end of february, you are still liable for rent upto end April. Hence you will pay for March and your deposit will be adjusted for rent of April.

2. Give them a very simple note mentioning your name, apt number and the date of termination. Keep it simple and basic. Get the super's signature for your records.

3. Despite this notice, they will have you sign on thier standard forms. Remember to keep copy for your records.

4. Atleast 1 week before your end, make sure your apartment is inspected and any shortcomings are noted in advance.

5. Most supers generally check for satisfactory working of kitchen appliances and your washroom functions. All other issues are minor.
