Hi

This question is for my friend. She entered into a contract to list her condo for sale one month back with a real estate agent. But later on, she didn’t like the way in which the agent operated and decided to take her condo out of the market and signed an agreement to suspend the listing. Now, she was told that she cannt list the house with another agent till the expiration of the original agreement which is supposed to be due on July 30th. Is this true? I think she was told by the agent on signing the suspension agreement by the agent that the agent has nothing to do with the condo any more. Can she not list it before the expiration of the original agreement?

Any comments/advice would be really appreciated

Hi Gauri,

You are right. Your friend cannot list the property with another salesperson as long at it's current listing status is "Suspended".

Your friend should call the Broker's office and request for "Termination" of the contract. Once this is done, she is free to list her condo with any Salesperson or Broker of choice.

Hi Mr. Rajeev Narula

Thanks for your reply. I have a couple of questions more. I just talked to her and it looks like her real estate agent told her that it is impossible to cancel the original agreement and she has to wait. In such case, does she have an alternative? Also, it is possible for her to sell the place through a private sale in this situation?

Hi Gauri,

I suggest your friend speaks to the Broker with whom the listing salesperson is employed since the listing can only be terminated by the Broker. Usually, the Broker would want to know the reasons for your friend's disenchantement with the listing salesperson and may try to resolve the issue.
