Hi,
CDs, I need help. I had a minor collision. Which I am sure didn't even take place as I was able to come to a complete stop before hitting other car from behind. Reason, I have a plastic cover on my front plate which wasn't even cracked or has any sign of a collision. The other party somehow is taking advantage of the situation and threatening to file a claim again my policy as both parties had exchanged insurance info. My question is without a police report will the other party be able to file a claim? There was no cop or any other witness on the scene. Mishap occured 5/6 days back. Any help or experiences related to this incidence can be of very much help to us in dealing with this. Thanks in advance.

In my personal opinion (strictly Personal Opinion and not a professional advice), first of all, take a picture of your car where it hit. Infact you should have taken it same day only but anyay, its never too late. Make sure that you have a 'date stamp' on that picture. Most of the digicams have that option. The purpose is that if the other party reports to his insurance companies that the damages were high, you can show your insurance company that nothing had happened. May be accident never happened at all.....samajhdaar ko ishaara
Also, you may want to wait till your insurance company calls you because if the other party reports to his company, your insurance company will surely call you to confirm. Was that a stop at the red light? Did he put a 'sudden break'? If you are determined 'at fault', it is going to be on your record whether you call the company yourself or not. So why take 'Panga' yourself. Just wait and watch.
Just to let you know that you can fight against the decision of the insurance companies. Write to their claims manager, write to company ombudsman. In most of the situations where companies are not sure whose fault was that because they are getting different stories from both parties and there was no witness, they put both parties at 50-50 fault. So 'Hum to doobenge sanam, tumhein bhi le doobenge'.
