US - L1 B

Hi,

I am on a work permit to canada, last month i had been to niagara, accidently crossed the canada - us border, later had to comeback with a letter "Not admitted to us without visa"

Now planning to apply for a L1B visa from here, there is question in the form ds-156, which says "Have you ever been refused admission to the U.S", can i know if this should "Yes" or "No", Please clarify

Yes, and give an explanation in the space provided.
It was an honest mistake and should not affect your case.

Hi,

But There is no space provided for giving an explanation (Ds-156 - Q38). Answering "yes" will have any negative impact on giving me a VISA ?

You can attach a sheet of paper with the explanation on it.

Did they mark your passport when they sent you back?
Did they take down any details, such as your name, passport number, address, etc?

In other words, if they recorded any details about you, you don't have any choice but to declare that you were refused admission.
In your explanation letter simply state that you were visiting Niagara Falls for tourist purposes and happened to stroll across the border post and were sent back.
Attach a copy of the letter.

However, if they had taken down no information about you, then it's your call whether to declare or not.

Are you applying in Toronto consulate?
When you meet with the officer, give them a brief explanation of what had happened.
It should be ok since you have done nothing wrong.

They did take my Info (passport details, thumb impressions) and a letter stating that 'admission to US was not allowed as no VISA", i had to give back the letter on the canadian border

As i am submitting the E-forms online, so will not be able to submit any additional documents on support of this. May be i can mentioned as "Yes" to the question and take a explanation document when i go to the consulate.

Yes i will be going to the Toronto consulate.

Is it that answering "Yes" will be taken as a reason for not giving a appointment for personal interview and rejecting it straight away
