Hi Everyone,

I am feeling very depressed today. We had our interview yesterday at the Abu Dhabi Immigration office and the officer has not given us a positive feedback. Below are details about our file. I would be more than happy if you could share your thoughts and insight on the position of our immigration documents.

We applied: May 2006
Received File No: July 2006
Asked for IETS: October 2008
Asked for Police clearance and proof of funds: November 2008
Provided IETS, Proof of funds and Police Clearance: December 2008
Provided Spouse Police Clearance: Jan 2009
Asked for Spouse Original Graduation Certificate:Jan 2009
Was provided immediately with updated documents and proof of funds

I had completed my MA, working as a Content Manager, and my spouse is a B.Com and working in Sales and Marketing.

We did not hear from them till May 2009 in which they said that we have to attend an interview on June 17, 2009 at Abu Dhabi office, which we did yesterday.

The interviewer was not the same officer who is assessing our file as he did not have my spouse's original certificate and was not aware that it is still at the London office.

He began well asked me for my original certificates and went thru them and asked me about where I am working and asked me to explain my profession. I gave him the url of the website that I work for and also explained to him details about my job profile. He was pleased and said it seems to be very exciting. Then he asked me the salary that I was drawing and I told him the amount and he said it is quite a sizable amount.

He asked for the proof of funds, I presented him the bank statements of my NRI account in Ruppees, the FCNR account funds and the funds that I have in UAE accounts, he also wanted to know the total funds that we have and I told him about it which is above the criteria that is required for immigration. Till now things were goin fine.

He then asked for my spouse certificates and while going thru them he asked my spouse about his degree as he has done it from KC College in Bombay and its an Arts and Commerce college so he was confused how can you have a commerce and arts degree, we explained to him that its Combined college for Arts and commerce but the degree clearly states that he is a B.Com graduate. He then began questioning my spouse about different accounting terms, different auditing process, means of certain jargons et al... my spouse answered the ones which he knew and the ones which he could not get well he just said he did not remember (instead of just pretending to behave as though one knows it) coz its been about 17 years (passed in 1993) that he has done his graduation in commerce and has been in sales and marketing since then... hence his profession does not require him to use commerce terms in day-to-day dealings... The interviewer was not too happy with his replies and said that he does not think the application can proceed further and we should be getting a letter from the office soon but he said its not that I think your certificate is fake but there are a lot of fake certificates coming from India and Pakistan hence they are very cautious but I tried to reason with him that this is not a fake one and if he wishes he could do the verification process, but he said that we can ask our consultant to appeal on this case and then it can be taken up from there and the consultant can appeal for verification but from his side (the interviewer's side) he does not think he can give a positive feedback on it.

We are completely stressed up with all these years of waiting and everything looked very positive and suddenly with this interview everything has turned up-side-down... and we are in for a shock.... just donno how to go about with it.

I would highly appreciate if all of you and the senior desis could give their opinion of the outcome of this and also their valuable advice of wut we should do? Our consultant has said we can apply for CAIPS and then the lawyer can take it up from there....

I am thoroughly confused and pretty low rite now... sorry guys for flooding you all with such a lengthy mail but wanted to give the complete details so that you get a proper idea of the developments and advice me accordingly.

Getting CAIPS notes is a good step, that'll give you an insight to what is going on as that'll have interviewer's comments.

You should definately appeal if you get a negative response, one of my friend had gone through pretty similar situation but in that case interviewer agreed to get the degree verified , it delayed the whole thing but resulted in a positive decision.

In your case who is the main applicant? if it's you, I don't see any grounds for rejection , but in any case if you have right of appeal, go for it .

Dear Mr. Shah,

Yes we are applyin for the caips as we will know wutz the status etc... yes I am the main applicant and hence I am very concerned as its was right for the interviewer to question my documents etc but I dont see why he had to go indepth on my spouse degree...

Pretty confused right now and not sure wutz the outcome after such a long wait whilst all our documents are in order etc etc...

Apparently there s nothing serious at this stage and the CIC center has rejected the Application based on some previous comments on the file ( the original degree was not visible to him and HE DID NOT SHOW KNOWLEDGE that they were in London ) ... Mark this point in the appeal ... it appears the file was not updated .

As long as the degree is authentic for which you might have to provide a verification from India while filing an appeal , I personally do not feel a problem ........... its perhaps more of a doubt they have and they should have verified it in stead of taking a gross view . The way I see it and CAIPS can confirm ... there must be a note on the file suspecting the spouse's degree and nothing updated with regards to the receipt of the degree by London CHC ....... So the interviewer tried to judge the validity by asking the questions and passed his decision ........Which can be reverted by proving the authenticity of the degree .

File an appeal and you should be good ...... The Officer has himself indicated that .. Just a little bit more head ache . All the best .

Thanks for your advice and yes we will ask our lawyer to highlight the point of the interviewer not informed about my spouse's orginal degree was in the London office.

Basically I am wondering about our chances of getting a positive outcome on the appeal... does CIC give its final decision based on the interview or would they ask me for more details before passing a decision.

And if according to the CAIPS I score above 69 without counting the points on my spouse degree can I ask them not to consider his degree and continue with my documents...would they do that?

And incase this is their final decision would they refund the fees and is it possible for us to apply again??

They can do both, pass the verdict without reasons or ask for further details. When your case is genuine and certificates are genuine you need not worry. It is time consuming but can be fought for.

The decision of selection basically is made on the Primary applicant qualifications but the spouse education and other points also help.

I'm not sure of the fees but yes you have every right to fight for it and reapply. In our case my husband who is a CA was the primary applicant and our application was rejected saying that he does not complete 17 yrs of education, they don't consider professional qualifications as CA etc in here. Our lawyer went to court and the decision was in our favor, we reapplied but this time under my name as I've done my masters which was very well under the 17 yrs. We lost 1-1/2 yrs in this.

Please don't loose hope, the decision is not made yet please wait and things will turn out positive.
