But if you are a Non Resident ( from IT purpose ) you don't need to file your taxes .... I guess we can continue reporting our world income to prove that its > LICO and still may not need to pay taxes ....

I assume the Income Tax and the Immigration requirements have always been different .

Can others confirm this ... maybe a link or something which points that a sponsor needs to maintain above LICO THROUGHOUT THE PROCESSING PERIOD .

Sponsorship Application process itself considers income in the preceding year and nothing regarding it being maintained during the whole processing time ....

looking for correct information please ...

According to CIC, whenever there is a change in your situation or circumstances, it is important to contact CIC.

You can find some information on what to do in this situation in the IP 2 Processing Applications to Sponsor Members of the Family Class manual.

Here is an excerpt,

"5.34. Change in circumstances

R134(2) allows for a calculation or recalculation of the sponsor's income if it no longer appears to meet the requirement of R133(1)(j) for minimum necessary income. The calculation is based on the 12-month period that precedes the day the officer receives the information indicating that the sponsor may no longer meet the minimum necessary income requirement. Income may only be reassessed downward. R134(2) is linked to R133(1) in that a sponsorship shall only be approved by an officer if, on the day on which the application was filed and from that date until the day a decision is made with respect to an application, there is evidence that the sponsor has total income equal to the minimum necessary income.

A calculation or recalculation may occur before the initial recommendation has been rendered. This could include cases where there are indicators that the Notice of Assessment provided initially may not reflect the current situation because the income reported appears not to be sustainable."

There is also some additional information in the same
IP 2 Processing Applications to Sponsor Members of the Family Class manual in Section 22.

"22. Change in circumstances

22.1. Reassessment of income after giving an undertaking
R134(2) allows calculation of the sponsor's income if it no longer appears to meet the requirement of R133(1)(j). The new calculation is based on the 12-month period that precedes the day the officer receives the information.

22.2. When to reassess income

Income may be reassessed at any time during processing if new information is received or brought to an officer's attention that indicates that the sponsor may no longer meet minimum necessary income requirements."

You can find some examples in this manual in Table 24.

According several CIC Call Centre Representatives, at this time, you may need to send a letter to CIC explaining your situation.

When you get another job, you will need to send another letter to update your situation.

You may want to contact CIC directly at 1-888-242-2100 (In Canada Only) for additional information on how to proceed.

Thanks G13 ,

It clarifies my doubts - re assessment can be done per need and not as a process ... but then one needs to maintain the LICO income throughout ...

Plus I ve also read some where that a person may be deemed to be ineligible to sponsor in case there s a doubts that he does not have strong ties with Canada or might leave Canada after the sponsored person lands up . This includes people having houses in Canada but

Dixie Bloor Neighbourhood Centre is organizing an information session for all permanent residents who wish to sponsor their parents for permanent residence in Canada, under family class. The session will cover the eligibility criteria for the sponsor, points to keep in mind while filling the application forms, applying for visitor visa while the process is on and effects of a sponsorship break-down.
