hey guys : anyone has any personal experience of a speeding ticket trial?
i'd like to know what defense you used, what worked and what didn't.
even if you weren't successful, please post your experience.

i have a trial coming up in the Waterloo/Cambridge region and would like to collect as much personal experince from fellow desis as possible
i have already read through several ticket combat sites and followed the steps they recommended such as disclosure etc.

now i'm looking for personal experices. thanks

Sorry, but I am no authority in fighting trials, but do appreciate your respect.

There is a straight forward way and the then there is a guerrilla way to contest a ticket.

Straight forward - enter a plea bargain with the prosecutor before the trial and settle for a lower charge with no demerit points. But you are still 'GUILTY' and it MAY effect your insurance.

The guerrilla way is as directed on the combat site, but I have no personal experience with it.

I have had only 1 trial and pleaded guilty with explanation way back in 2006. My fine was reduced and the points dropped. Fortunately, it did not effect my insurance.

Morally, if you did break the law, you need to pay for it.

But practically looking when the law makers themselves are breaking the law and getting away with it due loop holes in the system, why should the common man suffer alone ?

So depending upon which side of morality you are on, please follow your chosen path.

thanks for your insight, Hiren I was hoping you'd respond.
this is my first ticket too and I'm planning to go to trial.
but I have no experience or idea about what works and what doesn't.

my defense is that given the volume of traffic and the fact that I was in the left most lane of a 3 lane highway, there is no substantial guarantee that the speed recorded is my car and not a car beside or ahead of me.

basically everyone is driving at the same speed and vehicles are very close together so there has to be a genuine doubt which car's speed got recorded when the officer pointed the laser gun.
I'm planning to take pictures of the highway from the shoulder where the officer was positioned that day to prove that volume of traffic.

i do not know whether this is a valid defense or not.

it is hard to judge what is guilty and what's not because everyone was driving at the same speed and that's the case everyday (this is my daily commute route) so to single out one person each day is like shooting fish in a barrel.

i am tempted to take the offer of reduced charge if the prosecutor makes that offer, but i'll still be stuck with a hefy insurance for the next 5 years.

Your defence sounds good, mistake on part of officer is good reason. What was your speed?

Fighting the ticket based on traffic condition will need a lawyer..

It is worth a try if u can record the traffic speed and at that time and take it as evidence
