H1 is not as tough as in 2008. Even in 2009, we got approvals for a startup with just 2 employees. Its a typical desi company. For a person who did bachelors in US and worked there for 6 yrs, Its not a difficult to find sponsors.
If he is willing to pay costs, any SAM on sulekha will file his H1.
You are right - finding "any SAM" should not be a problem, finding "the employer" is not easy.

Pal, finding that Sam is no more a tom dick harry's act !!
U are trying to misuse some information that the person confided in.
I think u should give the person a chance and ignore the fact that he might leave.. There is no guarantee the new person u hire will stick around.
As far as GC goes there some loopholes people use where GC can continue to be processed without being present in US.
After he gets his GC he cannot be out of the country for more than 6 months , this was abused in the past, nowadays they warn the first time and 2nd time deny entry.
The person has 1 year before he can make a entry with GC and
It is a given that the person will leave in 18 months after he gets his GC.

I think you misunderstood me. I was enquiring for the following reasons.
1. He is not upto the mark
2. Even in the event that we decide to retain him, I do not want to train someone who will leave once he GC process requires him to be in USA and he leaving the job overnight.
Right now, he is handling a very important job which is not capable of doing but the management has given him the chance. If he goofs up, then the whole company’s reputation is at stake.
If you had been following me, then you would have known that I respect hard work.
Peace

Seems like you are creating trouble in India. I think it is not about the country it is about you .. You find and create trouble for you and people around you ..what do you think ?

We will find a way or we will make one
Guys,
I think you are missing the point.
I once used to work in Canada where even decent professionals (except IT and Finace) use to slog in their jobs at $ 10.5 an hour. Canada was not ready to give them professional work. So many people are suffering there.
Now India is booming with jobs. Thus guy that I am talking about returned from USA and is not up to the mark. He is paid more than his USA salary. He does not know Indian details nor does he know Indian terminology. Right now he is escaping since he is just talking to consultants. The project will be in a big mess once it comes to execution.
Why should I not look to replace him with a Canadian returned desi or a talented local who is not aware of this job.
While I used to work in Canada, I joined / gave employment to many people for $ 12/ hour job when they were at $ 8 or unemployed ($ 12 is the salary that my office used to give). I respect hard work and the degree.
Hope you understand.
Peace
