Question on getting visitor visa for mentally challenged sister

Pls help-----

I am a PR of canada and am married. I have been in canada as PR for six years and have well paying job (~ 100K per year)

My father is retired and I want to invite my parents to visit us in canada. I have only one elder sister and want her to apply for visitor visa along with my parents. The concern is she is mentally challenged (has down syndrome) and hence financially dependent on my parents and unmarried and her age is 32. She has had no education but can do her things on her own. She has diabetes and no other medical issues.

I am not sure if it is good idea to apply for her visitor visa as well since I heard/read that visa officer can reject my parents application too based on her medical inadmissibility !! Can any of you pls share your opinion/experience ?

I will be taking medical insurance for all of them. My father can show good ties to India in terms of property, bank balance etc and they have no foreign travel history.

Abhishek,

I have similar case. I applied for visitor visa for my father and sister two months ago. CIC approved my father's application however rejected sister's application because they did not think there were enough ties back home for her to go back.

I'll advise you to get in touch with a good consultant before filing application. Once rejected, it remains on her record and creates problems going ahead.

Thanks ut007. do you know any good consultant having experience in handling similar cases ? do you know if she would be eligible as dependent (due to disability even though above 18 or 22 yr age) under new parents family class immigration coming into effect from 2014 ?!

Any other thoughts/suggestion from other members ?

People with disabilities do travel and also have migrated to other countries. It all depends upon the medicals that they have to clear. See if you can obtain any medical insurance for your Sister 'first'. Then the topic of conversation could be resumed once more.

Also the Doctors in India may not allow that particular individual out of sight at all times, without an accompanyment. It will be the same if you have to leave her behind if your Parents want to travel. You are aware of that too.

Alternately, provide her with attendent care where your Parents currently make a home and see if the services are satisfactory, prior to availaing such a vacation, if they decide to leave her at the attendent care. Other wise, the question that you are raising are just hypothetical and you have a huge problem on your hand.

If you bring her into Canada, it will become a major problem to you at a later date. Also removing her from her familiar surroundings might be detrimental to her relocdation. All of these are to be determined through medical assessment. You be the judge of the same.

Incidentally, I have known groups of travelers out of India and occasionally with the whole family, traveling through USA and Canada and making stops all over, dpending upon the itinerary the Travel Agents have created. I know of one such group that traveled out of Boston Ma. through Quebec and via Niagara Falls. They also made a brief stop here in Toronto. If you so decide to avail such a tour for them, you can Google and find them too.

Also to see if the traveling with her suits you all and you can handle the journey as a small group, you can make a few local trips within India and a few out side of India, either through CEYLON (Sri Lanka) or through Dubai etc., locally and creatre a travel history and experience the efforts that you have to put into such travels, first, prior to doing longer journeys.

Last but not the least, if there are no other relatives and close family ties to you, there in India, and it happens that she will be the last one left behind, then there are feasibilities that she would be permitted into Canada with a permit from the Governor General of Canada and an application can be made for that through the political quarters, on compassionate grounds.

All of these revolve around family and closer ties there. That is a subject mattrer for another discussiuon.
