Dear Mr.Masoodji,
My husband is working in USA on a H1b visa for the past 4 years. Recently, we got our Canadian Immigrant Visa and is planning to land in Vancouver by road .
My husband changed employers and his old visa expired.He got a new visa but has to get his US visa stamped in his passport.
I request your advice in this regard.
1) Is it ok to apply for revalidation in Vancouver US Embassy?
or
2)We are thinking of coming back within 30 days using Contiguous Territory rule.
We are from India.
Many are giving confusing advice regarding this rule.
Is it possible to come back using this rule, as all our papers are in order?
We have not travelled outside US in the past 4 years.

You can use any option
1) or 2 ) Both are fine but if you use 1 and not successful then you cannot use 2 later

Thank you for your reply.
I know that we can not use option 2 if we use option 1.
What I am worried is will there be any problem if we use the option 2, and what if we are unable to come back, what if we are not allowed at the border in to US?
So, basically I want to know, on what grounds we may not be allowed back inside the US.

Well You may not be allowed in certain conditions back

1) If the officer at POE does not know this rule and does not let your get in.

2) If You or your wife do not have expired visas in the same category in your passports as what is extended.

3) your wife should also have H4 extension approval to enter USA if not a visa stamp.

Generally , you should be fine to enter if everything is right with your papers .

1)My husband has a valid H1 extension with I 94 valid till the end of 2005.He came on H1 visa only, when he entered the USA.
2)My son and I have also got our H4 extension and have the I 94 valid till the end of 2005..
3) Is it a good idea, though, to take a print out of Contiguous Territory rule from the web, in case the officer at POE, is not aware.
I was under the impression that everyone will know about the rule at the border. But, as you say, we can not take chance.
So, what can we do to ensure our entry back to USA.What precautions or step do we have to take?
My husband has a stable job here.

As far as my knowledge goes you guys are good to enter US , A print out will be handy .
