Immigration - When Husband is in Canada and Wife in India - Possible?

Hello Everyone,

Currently, I am in Canada more than 3 years and currently studying on a study permit. My wife’s Visitor Visa was recently rejected in India when she tried to visit me during this Christmas time. On the other hand I have already planned to migrate to Canada and want to put my immigration file from Buffalo, U.S.A. in coming days along with my wife’s name as 2nd applicant.

I wonder when I submit my immigration application at Buffalo; my file will be processed from there itself, during that time my wife will be in India. How about her application, will it be processed from Buffalo as well or her file will be transferred to New Delhi to process, or even mine? Any suggestions?

If it get processed from USA and we got the interview call, and in that case either of them don’t get USA visa, what happen during that time as well?

Please share your experience and thanks in advance.

According to the CIC website...

"Applicants for Permanent Residence
You must apply in your country of residence, your country of nationality or the country where you have been legally admitted for at least one year"

You cannot apply in Buffalo. You should apply in New Delhi.

Sorry to say, but you prove yourself wrong with your suggestion.

You cannot apply in Buffalo. You should apply in New Delhi. "

I am legally admitted in Canada for at least one year, as I am in Canada for more than 3 years, so I can apply from Buffalo and can skip New Delhi.

Correct me anyone here if I am wrong.

Well , I may be wrong but I think Buffalo is in the US , not Canada. Maybe we can check the map. Moreover I do not think you can change your status from Student visa to PR from within Canada.

I prefer if you have little or no knowledge/information to suggest someone on this forum, then please don't do it. Your suggestion will mislead the people out here.

Well I know where Buffalo is located and been there in past as well. May be you have to check out the map. Do it then get back to me.

FYI, as I am in Canada, I can submit my immigration file to the Canadian Embassy which is located in Buffalo. Upon approval of it, and when my status changes, I guess I can re-enter Canada from USA.

Take a deep breath and stay tight at the back.

Not reentering Canada. The issue is ENTERING the US. You'd better check. Anyways not my problem. Best of luck getting your PR.

It's not mandatory that I have to be in US to apply thru Buffalo. I can mail the application by staying in Canada. If this was your concern.

And after getting immigration, may be I can re-enter Canada from US border. I am not sure about this procedure. But I am sure there is a way out there.

I feel your concern was upto 1 part, so that is replied.
