Landing in Canada - Urgent

Hi all,

Please help me out in this. Recently I got Immigration papers.

And Visa Officer has adviced me to send the Passports for Single Entry (for immigration) and land/immigrate before March 31st to Canada.

Where as I am currently working in USA and my current H1B extension is under processing and I want to land in Canada sometime after my H1B approval (and I don't know when I can get my H1B extension approval the dates were not updated in the immigration sites).

Meantime, I will send my Passport to Buffalo Office for Single Entry visa, and my another question digging me up is that if I didn't land in Canada before March 31st, will my approved immigration gets cancelled or is there anything I should take care of.

Please advice me.

if you got your medicals done in march 2005 then you will need to make your landing here by march 2006 or you will loose your immigration and start all over again. i have acousin who let it go coz he thought his Gcard was coming through and that was 7 yrs ago and he is still waiting for the green card. why dont you make your trip here quick take a few weeks off then and make your entry - get your PR card and SIN # and go back. but make sure that the immigration officer at the border doesnt find out coz i have heard of cases that their entry was refused coz the officer thought they were entring just to get the card.

Hi,

If you want to get the H1B approval before landing, you can convert it into premium processing by paying $1000. H1B is approved or the letter for request for further documents is sent in a maximum of 2 weeks. Then certainly u can land before March 2006 with the approved H1B.

As Janmeja said if you don't land by March 2006, u have to start your immigration all over again.

Thanks for your reply (Raajen, Janmeja).

I am thinking of converting my H1B from regular to Premium and will follow up my attorney.

One more question is that if I didn't land before Mar 31st 2006, will my immigration get rejected (even I have sent my Passport for Immigration Single Entry Visa)?

My worry is that we are 4 members including 2 kids. So not able to make a wise decision of what to do.

If Mar 31st 2006 is the last date allowed for your landing, then you HAVE to land by that date, without exceptions.

Till today I haven't heard of anyone getting an extension of that date - even if it is possible, it must be something extremely rare.

Usually there is a last date by which you must send your passport for visa stamping.
That date is usually 2 - 4 weeks from the date your application was finally approved by the processing center.

So you have two dates to meet - the date for sending the passport, and the date for final landing.

Everyone doesn't have the land together - only the primary applicant must land first.
Rest can follow anytime later, as long as everyone gets in before their last allowed dates.

after cic approves your immigration they give you one year from the date of your medicals to do your landing. unfortunately you lost a few months because you didnt get the actual visa right after your medicals. once your landing is over and you have all recieved your PR card then you have to have live in canada for 3 yrs out of 5 to keep up your card. that is the reoson ppl with hib visas live in canada and comute to US to keep up with the PR. or have their families live here and the guy will commute every week to make sure you have 1095 days out of 5 yrs.

please remember that HIb visas are not permanent and to convert them to green card can take years. but PR cards are permanent. you have all rights except voting rights in canda. so if you can do the commuting i would erge you to think of living in canada and look for a job here. also remember that it is illegal to have a h1b visa from one country aand have residency of another . so be careful

Hey Janmeja,

You have mixed up things again. It is not illegal to have H1-B and Canadian PR simultaneously. It is illegal to have US Green Card and Canadian PR simultaneously.
