My parents were here from India, they got 2 years multiple visa in May 2006, They visited Canada in May 2006 till September 2007.
In Dec 2006, I have sponsored they for the immigration to Canada.
They came back in May 2007 at the end of there visit in August 2007 my wife was expecting and there were some complecations so they decided to stay here and we extended the visa.
We applied for the extension in August 2007 which was 2 months before the expiry ( 6 month period).
They got the extension in Jan 2008 so they can stay till May 2008. with the extension of Visa they were required to go through a medical exam.
They got the Appointment for March but due to emergency they have to rush back in March 2008. They left the country in March 2008.
The 2 years multiple visa was expired in June 2008.
In June 2008 my parents have applied again for the visit visa to Canada and got a refusal on there three points.
1. they have over stayed and did not go through medical.
2. dual intent ( that they have applied for the Immigration and now they want to spend time in Canada till they received there immigartion.
3. They will not come back.
We are on the holding pattern and need some guidence.
They are in good health and there are no medical issues or concerns.
They have no intension to jeapratize the immigration application and no intension to over stay in Canada.
What should we do????
My parents got 5 year visitor visa, they have been to canada 3 times in 5 years and to UK 3 times and back always within time limit.
I filed for their PR and next time they applied for visa after 5 yrs visa expired, they were refused for N no. of reasons that were not valid but as we have heard from many, once you apply for PR it is difficult to get visitor visa. Whatever reason they might give.
