Hi everyone,

My family landed in Toronto in 2002 and stayed there for 1 month and
returned to Dubai again we went in 2004 and stayed for a month and returned.

The PR card is valid until 2007. Can we travel to Canada on the PR or
do we have to start again for the new PR.

I would be much grateful for the information.

Could you specify the landing and other entry /exit dates ?
May be then some can give a realistic opinion.
Otherwise your case looks complicated, and in trouble.

A similiar case has been discussed earlier on this forum and replied by the immigration expert. Please run a search on this site's forum.

As far as I can remember:

I think you can still travel to Canada as long as your PR card validity has not expired. However, there are little chances for renewing the PR card for another five years unless you have genuine reasons to prove your case in the immigration court.

Why dont you consult the Canadian embassy in Abu Dhabi?

The immigration act requires you to spend 730 days in Canada in a running period of 5 years. The period of 5 years is caculated from the date of examination at the port. So say, if you were to arrive on Mar 30, 2006, you 5 year period would start on March 30, 2001 and you should have spent 730 days in Canada from that date. If you have been a PR for less than 5 years, then the immigration officer at the port of entry will provide you with an opportunity to prove that you will be able to meet your residency requirement. If the immigration officer has some doubts about it, he still will allow you to enter, but you may be called to the Immigration office for Inadmissibility hearing.

However, no airlines will refuse to board you on a flight to Canada as long as your PR card is valid. It may also be important to remember that once your PR card expires, you can get travel authorisation document from your local Canadian visa post as long as you have visited Canada once (even for a day) in last last 365 days.

We (wife, son and myself) done our first landing on 04/07/02 at Toronto and returned to Dubai on 04/08/02. Again we ca.me to Toronto
on 11/07/04 and returned to Dubai on 20/07/04. Due to various reasons we were unable to go back and been told by one official of Abu Dhabi embassy that as long as the PR card is valid we can travel.

But recently another officer sent us following mail.

We are confused and would be grateful if anyone can guide us in the right direction.

You have a few other possibilities:

- Apply for a PRTD and try to make your case. See attached kit.If the visa is issued, you would need to travel to Canada within a month. If you are refused, you can appeal through the courts in Canada.
- Sign a voluntarily relinquishment of status and turn your cards into the embassy. Then you would have two other options:
- apply for a TRV to visit Canada when you want.
- re-apply for immigration so that you can go to Canada when you actually intend to, especially since it seems your plans changed considerably since your immigration interview.
