I and my family have been holding PR status in Canada since early 2005 but due to certain extreme adverse circumstances back home in India we could stay in Canada for a very short duration in the beginning. There seems to be a 730 days residency obligation for retaining PR status which we may not be able to fulfill. However, I sincerely wish to go back very soon. I have sent in a request for waiver of this residency obligation on humanitarian grounds to the Canadian High Commission in Delhi around a month back but I am yet to get a response from them. Our PR cards are valid till Dec 2009.My problem is that we go back to Canada and are there till expiry date of PR cards, how do we extend our stay there and remain a Permanent Resident .Please advise on the possible alternatives available to me.

You landed here in the EARLY 2005. Your five years run out in EARLY 2010. So, you have time till 2010 to complete your requirement of 731 days. It is late 2007 now!! So, we have whole of 2008 AND 2009. and one of them is also a leap year. Voila.
Ah So, Why are we fighting and arguing over our friends' getting back into CANADA?
If you are going to wait for a letter from the CHC telling you that you are free to come in any time, YOU and your family will be waiting till the COWS COME HOME! You have no problemo!!

Pack your bags, get your Passports in hand, book a ONEEWAY Ticket to the Cajun Paradise (Is it Pair of dice?) Bring your better half and the kith and kaboodle too.

You already have a few days under your belt from your first visit. Bank them. Now add the days from your date of entry after you land here and see if you come up with 761 days, in EARLY 2010. (Two years plus a day for safe measure) and if you don't, then, hang an anvil by the rafter and let it swing. After that position yourself so that it will come and WANG you right where the sun doesn't shine, and in the back. Spare your family heirloom this time. If it has not done that by now, then, this will surely do the job.

Sorry if I am getting a little nasty but humorous. Some times I get carried away.

Welcome back SANJEEVOHRI and family, the next one is on you.

Freddie.

Landed in early 2005 and PR card valid only till Dec 2009 ?
I don't get this, could you please specify the exact time frames (dates) of your landing, PR cards issue/expiry dates and also when did you leave Canada?
I guess the PR is valid for exact 5 years from the date of landing. this is true in my case for sure.
can some one validate this please?

Guys,

I am overwhelmed by the level of interest shown by you all and the advice provided. Thanks a ton and please provide your inputs based on the following.

Let me clarify things and provide you the background. Actually, I and my family landed in Toronto and became PR on Nov 26,2004 . We stayed at our relative's residence there for around 8 days and had to leave quickly due to issues back home. The PR cards were delivered at my relative's residence in Toronto and he sent the same to me. My PR cards have Dec 6,2009 mentioned as the expiry date.

As per the link containing info on PR status provided by Freddie (my special thanks to you), the following statement is very disturbing :

"Possession of a valid PR Card does not ensure that one's permanent resident status will remain valid until the expiry date. In some circumstances - notably where breaches of residence obligations are involved - permanent resident status can be lost before this date."

Does the above statement mean that even with a valid PR card, I am bound to lose my PR status soon and will be denied entry in Canada. Which means that the residency obligation clause is verified & enforced not at the end of validity of my PR card , but now when I enter Canada with less than 730 days in balance.

The PR Call Centre nos (provided in the link) are for people calling from within Canada. But , I am currently in India and need to check on the validity of my PR status today in Canada. How do I do that ???

Can you guys help me here ???

If we were to extend the welcome that we owe to you, we need your honored presence together with your spouse and the family??, back to the ice box, before the 5th of December of this year which is by the by is 2007 (Wake up you.....). All of these changes are due to the exact nature of the information that you have provided us here in your amended statement. After that, they will switch off the lights and roll up the side walks and we pull the red carpet from under your lazy donkey, then the rest of your own quoted statement will apply to you.
So, do not wait any longer. Just take a tooth brush, your Passport that I hope is valid, your Canadian Maple leaf PR Card, a credit card to get you through and in your pajamas and then lift and carry your wife in your arms, with her purse hanging down to the floor, and the kid if you have any screaming its head off, and take the NEXT available flight to your friend's location here in Canada. Then, you will be here one day ahead of the deadline.
Hows that for the correct scenery?

Boy-o-boy, you sure do know how to cut the chase to the wire. Thats too close for comfort.

Good Luck. Safe landing.

Freddie.
