Friends,

I and my family have been holding PR status in Canada since early 2005 but due to certain extreme adverse circumstances back home in India we could stay in Canada for a very short duration in the beginning. There seems to be a 730 days residency obligation for retaining PR status which we may not be able to fulfill. However, I sincerely wish to go back very soon. I have sent in a request for waiver of this residency obligation on humanitarian grounds to the Canadian High Commission in Delhi around a month back but I am yet to get a response from them. Our PR cards are valid till Dec 2009.My problem is that we go back to Canada and are there till expiry date of PR cards, how do we extend our stay there and remain a Permanent Resident .Please advise on the possible alternatives available to me.

I think your first concern should be if and when you'll be allowed back into Canada. Once you are here, you should not have any problems with maintaining your PR status regardless of the expiry date on your PR Cards. You can just apply for a new PR card once it expires... besides the card will only be required if you were traveling in and out of Canada.

Thanks for your prompt reaction. Actually, I should have no problem in landing in Canada as long as my PR card is valid.I am more worried about the futuristic scenario for me and my family in Canada. When in Canada in 2009, I apply for renewal of my PR card(along with my PR status) near the expiry date, I fear that the Canadian immigration authorities may refuse to do so on the grounds of insufficient stay in Canada. However, since I will be settled with family and working in Canada at that time, i would like to continue my stay. Please advise on how to legally stay in Canada at that time.

OHR--u need to only concentrate on entering canada because if u have not met your resdiency requirement ,they can tell u to go back when u land here.They may give u some time to go back

PR card validity and the residency obligation (which is more important to enter Canada as a PR) are two different issues. If your PR card is valid but you have not met the residency obligation you WILL HAVE problems entering Canada as a PR.

Apply for Travel Document to travel back to Canada , giving all your details correctly. They will accept your aplication on Considerations ground. Come to Canada . stay there - everything will be solved when you reach residency days required by the act.

No need for the travel document since his PR card is valid.
