Please correct me if my understanding is wrong - PR as a document allows you to enter Canada as long as it is valid .

Residency requirement is a different thing however - the 2/5 rules that is .

So in case a person has not re entered Canada after 4 years of landing and his PR is still valid - will he be disallowed to enter Canada - I presume not as the Immigration Authorities would not check his residency obligation fulfillment .

So when does the residency obligation check come into effect and by which department - in other words what happens if in the above case the person re enters after 4 years and then stays for another 4 years ...... Is he deemed to be fulfilling his PR obligations or not and which department regulates this and when ???


I am sorry but just a couple of gray areas - wonder if some CD has got the answers . Thanks .

I read you messages. I have same story. I got my PR Card o 04Feb2004 and it will expire in Feb 2009. I am in India right now as I have not been able to completed 730 days in Canada. Can I enter Canada now and stay for 2yrs without going out of Canada? What will happen to my PR Status after 16Feb 2009 when my Card will expire ? Will Canadian Immigartion allow me to enter Canada now if I move now ?

You mentioned that you had applied for Travel Document form Immigartion Authorities in New Delhi. What is that can you elaborate ? Pl advice waht is the best course of action I want to go to Canada at the earliest.

listen friend if u are going to get scared and then take action then defnately will land up in trouble. dont be afraid , these lawas and regulations have been made for all in general and it is not somethig which is a writign on your fatelines. go to canada if u think u can affrod it and have nothing much to loose in India. or in worse case u loose a ticket fee. but if u get thru (which is likely to happen) and u can work and earn for this time i am sure few days wont matter and the guys need people, they canot throw u out for few days as they have to reply to their ministries why a few days grant was inadmisiable. as a matte rof fact they will be searching for a ground where to give you the stay. so dont b afraid. in canada if u fear the simple laws and dont fight back then u maynot be able to live in this country. untill u have a criminal history i think u can always stay here. comeon the majority of people here landed without passports, some even swim their way in here and when they are allowed , u are far better. cheer up.

Fido, I believe you are wrong. An un-expired PR card does not always guarantee you entry into Canada.(if you have not fulfilled residency requirements upto that point OR will not be able to fulfil the residency requirements in the 5 year period).

However, in a case where someone has an un-expired PR card ANd has not been in the country and WILL NOT be able to complete their residency requirement before their PR card expires or otherwise, most likely the officer will let you in and flag your file.

You will be questioned each time you enter Canada and I don't know what will happen when you try to re-new your PR card.
