"Verification of residency data is done only at time of renewal of PR card?" says who?
Anyway, I think helpful members like cdn_dude have already mentioned it on this thread as has jonav that your PR card has nothing to do with whether you will be let in or not.
Let me tell you, the CIC officer at the port of entry is the only person that matters when you are trying to enter Canada. If they are suspicious (from your passport stamps) etc. that you have not stayed in Canada for a total of 2 years in a 5 year period, they can and do ask you for proof, such as lease agreements, drivers license, taxes, pay stub etc.
If they are convinced that you have not stayed for the 2 years, they can deny you entry. Now, hopefully(for your sake) you will get someone at the port of entry who may not care.. but don't be under the impression that all is well and good, just because you have a valid PR card. And yes, the CIC officer at the port of entry does have access to updated data regarding your comings and goings out of Canada, especially if you have been flying in.
Yellowknife - In your statement (as below in quotes), I feel you are mentioning the scenario I may experience after completion of the 5 year period i.e. if instead of going back now , I travel back to Toronto in Dec 2009....Also, if they have complete data on my stay and I stand by them, they would ask me reasons for not fulfilling residency obligation instead of proofs of stay as mentioned by you...
" If they are suspicious (from your passport stamps) etc. that you have not stayed in Canada for a total of 2 years in a 5 year period, they can and do ask you for proof, such as lease agreements, drivers license, taxes, pay stub etc."
what i mean is they will go from the date you became a permanent resident and see if in the 5 year period following that you have maintained or will be able to complete 2 years in the entire period.
Anyway, good luck.
This is a very interesting thread. Our PR card expires in July 2009 and we will not be completing the required 2 years stay in Canada before the expiry of our PR card.
I was just curious to know suppose if we re-enter Canada in May 2009 through the road from US on a private transport (I heard the POE officials do not thoroughly check people travelling on private cars) and if we manage to enter Canada without any questions, are we eligible legally to stay in Canada for the next three years without leaving the country and obtain citizenship. Is a valid PR card required for obtaining a job, driving license, OHIP card or later when we apply for citizenship, as we may not be able to renew our PR card.
Suppose after we enter Canada in May 2009 and if we apply for a PR renewal stating that we have met the required 2 years residency in Canada, are there any definite way they can verify our stay in Canada. I understand the current waiting time for PR renewal is 2 months and if the authorities are not very strict in checking the documents for PR renewal, we should be able to collect the renewed PR card if we stay for 2 months in Canada, as they expect you to collect the renewed PR personally and thereafter travel out of Canada.
I would appreciate receiving your views. I am just imagining all those people out there saying this is foul play and I am cheating the system !!
Well firstly, of course if you are unable to complete the 2 years stay requirement in a 5 year period, and try to enter Canada pretending that you did complete the requirement, you are cheating the system. But then again you are not alone, there are thousands of people trying to do the same thing.
I know a lot of people are talking about the expiration of their PR card. I am not sure what sort of scrutiny people come under when they try to renew their cards, but you do come under scrutiny when you apply for citizenship as all your passport stamps etc. will be checked. So assuming you are successfully able to cheat your way through (the POE) into Canada, the next real hurdle you might face would be if and when you apply for citizenship.
And yes, you do need a valid PR card to get OHIP I believe, or at the very least they might check your passport stamps sometimes.
No No You are not imagining, it is true and do not try pinching yourself awake when you do this because you would be a cheater if you do this.
