Hi All,
Currenetly I am going through uncertainty and confusion any help will be appriciated.
My parents are visiting me on Visitor Visa.I had sponser them in April 2007.
I am the only son of my parents and my dad is over 70. Now he is old to handle the all problems in india him self. He also had some health problems due to confusion and stress of being alone in india, He lose 20 kg weight in just 1.5 years. My mom cannot handle all routine issue herself.
They get the visitor visa and they are visiting me right now. I see significat improvement in my parents health as now they are realxed and feel comfortable with my family.
I believe their file for PR will opne in 6-8 months. But I don't want tolet them go back. I am scard if they go back they might again run through same problems and anxitey can cause serious health problems.
Is there any way so that I can keep them with me until their PR file is proccessed ?
I heard lots of talk about the official rule of allowing parents to stay until their file is proccessed but could not find any evidence after searching lot of time on CIC website. I did many searches in the Charcha but couldn't find any matching case.
Please share your knowledge or expecrience .Your help will be apprciated.
Thanks,
Ulkesh

Unfortunately, parents cannot stay in Canada without a valid visitors visa while their sponsorship application is under process. In your case, the best solution is for your parents to apply for a 5 year multiple entry visitors visa. This will allow them to stay in Canada for upto 6 months. If you can arrange for a similar U.S visa, then they can go out of Canada for a day or two to the U.S at the end of every six months and return back.
Since you have already sponsored your parents in April 2007 and the current sponsorship approval date is at Jan 8 2007, you should get an approval in the next 3-4 months. Once, your sponsorship is approved, your parents might have to return to India to arrange for the paperwork to be sent to New Delhi. If you have somebody who can send the correspondence on your parents behalf from India, that can be a possible solution. In terms of medicals, if they are in Canada when they receive notification, they can get it done over here.
Since you are more than half-way through the process, I would strongly advice you not to jeopardise it by letting your parents overstay their visitors visa or applying on humanitarian grounds (as chances of approval are less). Just find a way of tiding over the next 2 years till they get PR.

My parents have got there medical cleared and request for passports have been put forward by Delhi office.
However, as they are traveling to Canada ( on visitor visa), I have to send Delhi office passports from Canada. Once they stamp and I get it back, one has to call 1-888 number ( CIC website) and set up an appointment with Immigration officer to get LANDING papers. ( If they have US visa, they can cross the border and come back)
One need not go back to his country of origin.
I had similar problem as no body would have been India to collect letters. So had requested all documentation to be done at my Canada address ( change of address).
Hope this helps !!
