i need some serious help as many of you have nice knowledge of things.
i started job in manufacturing in June 2008 . i got Temp. lay off on 10 th April 2009 and in month of August i got letter for extension of Lay off till indefinite period.
i am on EI now and has applied for Second Career.
in Sept 2009-1 st week my company called me to back to work,As i was not home they left message.i did not call them back as i do not want to go back due to various reasons like,
- everyone at hourly paid level are treated like d** or sh**.
- highly miss-managed company.
- got first 02 orders in 2008 since the company started in 2006 and lost them due to poor quality of supplied product .
- i started in small R&D plant and then they moved to bigger location in name of expansion, but the manual labor procedure remains the same (R & D has production capacity of 400Kgs/cycle but in new plant it was 2000 Kgs/cycle.
No equipment, only manual feeding of raw material by only One person.
- it was a foundry so environment was hot but even after repeated request no air circulatory system or fans were installed (it was like -15 Degrees out side in December but still very hot inside).
- False promises for every thing.
- was dumping HCl mixed water without any treatment in to drainage.
- air pollution inside closed building like loose debris,dust and chemical fumes.
THIS ALL HONEST AND TRUE .

- If any one off us Refused to work due to real safety reason (there was)we were threatened to fire indirectly.

I UNDERSTAND THAT SOME ALL OF THESE ARE NOT MY PROBLEM,BUT I AM WRITING TO HAVE YOU GUYS BETTER PICTURE.
OK so they sent me 'Termination letter' and updated ROE saying i quit the job and it was back dated on the same day when i was laid off originally.
(10 April 2009) they also sent it to HRSDC.
i have no problem with that as technically it is 'quit.'
my sole intention is looking forward to new career and future so i did not file any complaint or claim with any Ministry or board when i worked there and obviously to avoid any confrontation in your early career in new country.I was believing that every thing takes time to settle.
(plus i am not that king of guy who complaint in small things)
But now i feel that some times you have to fight back to some nasty stuff.i want to teach them a lesson in all possible and legal ways.
what are my options?
Ministry of Labor ,Environment, city council ,Lawyer etc
mean while 14 Oct is the date for decision of my case regarding EI. as per my understanding i am not eligible any more,but i am worried about my second career case.

I am a Gents and not a Ladies.
You should worry about your Second career , dont try to go after company ( chances are u will loose, also management can be bad but for that u cant blame company. u should have complain while u were on job , its to late)
lets get back to original query:
u didnt mentioned exact date when did your EI started ?
did already get approvel for courses ?
- if u already have approval and u have register with any istritute then it will not effect your second career even if you comapny call back .
but if u are still in process then u have to really push your case .... in that u can say that management was really bad towards u ,,descimination, harrasments are good words to use to make your case stronger.......good luck

I think u can still contest your EI claim on grounds that u were never called back to work,Since all ur company did was leave a message for u come back.
Once you are laid off i think you have a right to refuse work that you dont want.
EI does not force you to go back to the same job or on any other job.
Since you have the original letter of layoff u have a good case..
When u meet the EI officer maintain a stand that you were never called back and did not quit on your own accord.
U can still get funding for second career.
