I am working for an organization which is soon be restructuring. So they are planning to lay us off.
I have a couple of questions:
1) If they give us a package in lieu of notice plus my leave days, is it true that I will not get any EI for the first month?
Does the size of the package determine which month you can start applying for EI?
2) Do I then get EI for the next 6 months? So in my case if they lay me off in 1st Dec 2008, do I start claiming EI from 1st Jan 2009 until 30th June 2009
3) In was planning to go to India … should I file immediately after been laid off in Dec or should I file after coming back.
I was planning to go to india for around 1 month so be back around first week of Jan 2009.

That depends on the area that you are living in. In toronto,

the Minimum Number of Weeks Payable for Regular Benefits is 15 weeks.
So in your case, less than 4 months.
You MAY be able to enroll on a course which can prolong the EI benefits. Whether you should enroll in the beginning or near the end - I am not sure. Hope somebody else can guide you on this.

"Delaying in filing your claim for benefits beyond than 4 weeks after your last day of work may cause loss of benefits. "
Now, your question whether you can receive EI for 14 weeks after coming back from India is a good one.
Does the 14 weeks start the day you were laid off, or do they start after say, you coming back from India after for example spending 6 weeks in India.
I don't know. Maybe other Canadiandesi members maybe able to give their input on this.
4) Additional Info
When should I expect my first payment?
If we have all the required information and if you qualify for benefits, your payment will be issued usually within 28 days from the date we receive your application. If you do not qualify, we will notify you of the decision made on your claim.

Sorry for the outdated info I had given in my previous post.
I just gave some information base on my layoff in 2004. Things have changed after that
Hi,
My gross pay is just over $4000 per month - which they have to pay me in lieu of notice.
Plus my vacation dues - around 20 working days.
I think that brings the total to around $7000.
Does anybody know how that affects the maximum payment of $435 (of EI) per week?

if you receive EI, you are allowed max. of 2 weeks (officially) in which you can do other things (incl. travel outside of Canada-the frozen land) apart from looking for work which is the purpose of EI.
Though the EI dept. does not keep track of what you do in the days that you are on EI (apart from calling you one day to the centre and informing you the options in EI), it is your duty to inform the EI official when you will be availing the 2 weeks allowed to travel outside the country.
