Q. my father-in-law stayed at our place until may 2010. He moved permanently to Ontario in june 2010. Can I file his income tax for 2010 for the full year or can I only show him as a dependant (over 65 years of age) for the first 5 months. His only income is OAS cheque from the govt. The idea is to send him 1/2 of the extra cash that I get in return or is he better off filing his 2010 tax in ontario. Thanks

If your father in law is going to be a resident of Ontario as of 31st Dec, 2010 then he is supposed to file his tax return in Ontario. Having said that, if you took care of him for any part of 2010 you can still claim care giver expenses but you should know his net income for 2010 and also no one else should claim care giver expense in Ontario for 2010. Or, you can split the claim with some one else as well but the total claim can not be more than allowed for him.

2. If the person (PR holder) stays 2 months in 2010 in Canada and then leave, will he be filing tax return for that year? He has worldwide income from other country.

In both cases if the person is not moving out permanently out of Ontario or even out of Canada or does not become a Non Resident for tax porpose and comes back to his house in Ontario, he would be a resident of Canada for tax purposes and would file Ontario Tax Return.

And yes, he would have to declare his world wide income in his Canadian Tax Return.

I have gone through these links and what I understood is that the person will always be considered resident of Canada if he/she has SIN,Health card or bank account and I believe that if u have PR then u will most likely have one of these cards which means u will be resident of Canada no matter where u live. Am I correctly understanding.

Is it possible that a person can be resident of two countries at the same time i.e. if u stay in India for more than 6 months then u r considered resident of India (Not NRI), in such case will that person be resident of Canada also?
