My paralegal requested the City of Miss for the disclosure. The trial was originally set for Apr 1 but since the paralegal is going overseas he got it shifted to July 25th.
I happened to drop by his office to pick up a copy of the disclosure and noted that the city had sent someone else's information on the police report, officer's notes and accident report. The guy had a similar last name as mine and his accident was a few days after mine.
My paralegal returns on Apr 2 and I will talk to him once he gets back.
However, is it fair to assume that the charges against me (careless driving) will be thrown out because of the error on the part of the City?
Does this strange occurrence help me or act against me?
Please advise.
