Hello Desi buddies,
We are married in India. Me and my wife never lived together, now she immigrated to Canada recently and don't know where is she! I am looking for divorce here in Canada. I am confused if I got the divorce here, will it be valid in India if she does not contest? What things do I have to keep in my mind while filing divorce? Please advise and help.
Sir,
It is a complex issue. One of my friend, had a similar situation. Let me explain.
You say you were married in India but never lived together. Do I assume that you were working in Canada, went to India, married, came back and applied for her PR and she got it and never stayed with you?
In this case, you are liable to provide for your spouse for 3 years or so. So if she goes on welfare, the govt. will deduct this money from you. May be you can ask the police for help. A lawyer is needed for proceedings. If you have no money, pro bono (free) legal aid will help. Hope you got the point to hide your money. Police complaint is essential for your safety as she never showed up.
One poster before on CD said that you must annul the marriage in India also. So you have to fight for it twice. For divorce in India, contact Indian lawyers in India or make up your mind, never to go to India again. If your wife comes to India, and knows when you come to India, she may file a case with the police to stop you from leaving India. Since you have no children, the judge may decide your case fast and you may also not loose much money (India).

You say you sponsored her and she landed here. (Any details about her Flight??) Now you must have all her Passport details and with that information, report to the CIC Center, that she did not appear here in.. the town you are living. She is no longer your responsibility and so, you want her deported back. But it will be better if you can write all of the details in a letter with a copy of the passport that you have and make a request to them. They will delay the issue of the PR Card. They will also know where she is, because of the PR card address that they have with them. Let all of these matters take its own course. You take things as they come.
First things first. Take care of the other matters later.

Have you tried Facebook?
Register as a different user and search her. Could be that she might have blocked your original profile.
Also register with Shaadi.com. She might be looking for another person to marry and bring to Canada. This can work for you.

No it was not sponsorship but added her name as a dependent! No details about her flight though. I reported CIC everything about the fraudulent act but they didn't responded yet. Yes I am doing the same thing, taking things as they come. Is there any way I can track her location through Internet medium?
Dear yes you can hire an attorney in Canada and have need to provide him complete detail about your marriage and documentation. while your case will be in court then court will be issue a letter to find out your wife and after they will find out her in Canada and then you can process for your divorce.
