Hello
Recently my sis was divorced in USA on ground of "irreconcilable difference resulted in the breakdown for the dissolution of marriage" which happened with a mutual agreed upon uncontested divorce in USA but they were married in India.
My question is this divorce grounds legally recognized in India according to the hindu marriage law, or does she have to file for divorce in India as well against her ex husband.
Divorces completed with Mutual Consent will not experience many hurdles when they are obtained in USA and again when they apply for one in India. So, it is a process that needs to get completed a second time, there in India too.
SO, be aware.!
The reason being that they might want to get re-married once more there in India, who knows? But there are a few loops and hoops that they will have to go through when they apply for a permit to do so. Only a few good lawyers know and will help you from the start.
Here are a few articles that will give you an idea, which are written in a legal format to hide the real identity of the participants there. They were written a few years ago and the latest was last year 2014.
Good reading.
FH.
