Indian couple living in Canada since 1999 will be filing for a divorce this year. Canadian assets can be divided locally based on local laws.
What happens to Indian assets (home, pension funds, etc)
Do Canadian courts have any jurisdiction to decide on Indian assets?
Best to consult a lawyer.
In the past, jurisdiction was somewhat in grey area. That seems to have been resolved by Indian courts. In other words, our desi judgie-wudgies can give a rats behind to foreign judgements and quash them at will.
Don't know if the Canadian courts do the same with regards to Indian judgements. Usually, your place of residence decides which jurisdiction applies to you. So check on legal forums if your Indian assets come under Canadian courts jurisdiction.
If possible, conduct your legal affairs in a manner where the laws of both the jurisdictions are covered.
