I am landing in Toronto next month. I will keep working on my current project for my current employer in U.S.A. I plan to work remotely sitting in Toronto, maybe as a contactor. My employer has agreed to do so.
Now, my question is about the I-94. Do I have to submit my I-94 to the U.S./Canadian authorities at the time of landing? Do I have the option of not submitting it? I want to keep the I-94 and get my passport re-stamped from the U.S. Embassy in Canada. My stamping expired 6 months ago. But my H1B is current and I have the I-797 and I-94.
All I would like to know is:
1. Do I have to tell about the U.S. project to the immigration officer at the landing?
2. Can I keep the I-94 with me at the time of landing?
Any expert advice will be appreciated.

If you are not planning to reenter USA within next 30 days you are supposed to handover your I94 at POE officer.Because your H1B stamping already expired even u don't submit I94 and return within next 30days still POE officers may deny your entry without new H1B stamped visa.If you are planning to get your H1B visa restamped in Tornoto US consulate you should submit your I94 at POE .Remeber I94 is the doc which determine your valid staus in US and also record your arrival and deperture .If you don't submit I94 and apply for H1B visa stamping consulate officers won't be able to track your US deperture record and that could create problem
Lastly you don't need to submit your I94 doc when your are getting H1B visa restamped outside US(You can take a photocopy and submit just as an additional doc but that's not a mandatory requirement,your visa will be based on approved I797 and letter from the emplyer ).I94 photocoly is required when you are applying for extension of stay /change of status within USA
