Hello Sir,
Mr. X is in Canada since last 5 years. He first came on student visa. later he got work permit & visa for a year. Then he applied again for work permit after a year. Same time his file for PR was in process from Buffalo.
He got work permit for 3 years but he did not take visa for the same because he got PR. He had to enter canada as a PR, he went to india and thought when he returns, he will enter as a PR.
Fortunately, or unfortunately, he got married in india and on his return, he had interview at airport by immigration officer. He was asked if he was single and he said he was married. The papers of PR said he was single. Not to mention, only 1 week had passed that he was married and had got no time to inform them about the change. Also he was not aware that he had to inform this, before entering canada.
They took his passport and now it will go through a legal proceeding.
This was totally unintentional. He also has 5 years multiple entry visitor visa for usa.
Your comments ?
How serious is this ?
Can he be deported?
Can he loose his PR status ?
Should he hire a lawyer ? (any suggestions ? I am asking you this because some lawyers are specialized in handling particual kind of cases). How much do you think would a lawyer charge for this or would it be reasonable to pay ?
Thank you,
Aashu
I got a mail that Jago Desi has replied to this thread but I cant see any thing posted here.
Ignorance of the law is no excuse. Many assume that they know EVERYTHING about Canadian immigration ...
Anyway, my answers to your questions follow:
How serious is this ?
- CANADA TAKES EVERYTHING SO SERIOUSLY THESE DAYS. THEY MAY DETERMINE THAT THIS WAS A MISREPRESENTATION.
Can he be deported?
- LESS LIKELY [ALTHOUGH POSSIBLE]
Can he loose his PR status ?
- YES.
Should he hire a lawyer ?
- YES. HIS BIGGEST PROBLEM IS TO BRING HIS WIFE INTO CANADA. BY NOT DISCLOSING HIS MARITAL STATUS BEFORE LANDING, HE CLOSED THE DOOR ON HIS WIFE. AN IMMIGRATION WILL ADVISE FURTHER.

Dear Massoodji & Ashu,
I am sorry to post my query in this thread only, but looking to the same feel of the issue I thought of posting it here rather then creating a new topic.
Massoodji, if you remember I had sent you my friend's typical case of divorce and honest disclosure of merital status etc... He got his Visa as you know, but now he has one more problem/doubt. Recently his wife had to under go a surgery called LEPROSCOPY, i.e. for the removal of a FIBROID outside the uretus. Now this is taken in INDIA as a very common issue to pregnant ladies. Lot of doctors even do not remove it and do the pregnancy delivery. My friend's wife did not have pregnancy but had this fibroid, they decided to remove it. She is absoulutely fine and back to her job etc..
My question is, what should my friend do?, whether he should disclose about the surgery now, when he has already got the VISA? or he should forget it?
Please guide us (looking to his poor english, I have been having an extra task of writting.
Rgds,
VJ
They should be fine, especially if they've already done their medicals.

Sorry to trouble you again Massoodji,
But the operation was done after the VISA MEDICALS finished and the VISA was issued to them.
Is it still fine, if they do not disclose? In fact the doctors are saying that this is a very common surgery taking place in INDIA now a days, with pregnant ladies.
Please suggest.
regards,
Vj
