I entered the USA in Jan 2005 on a L1A visa, my visa stamp is eligible till Jan 2006 but the petition is valid till oct 2007. I would like to know if this will qualify as one year eligibiligy to apply for Canadian PR (I am the primary appicant)and also my wife is in India right now and wil be joining me in 2 months, if I give her address as the one in India since she is there currently will it hamper the processing?

you can apply if you meet the minimum requirements. You can apply via USA. Your wife being in India will not have any adverse effect.

Hey Sabgau,
It will be great if you apply from USA, as the processing times are shorter. Here are a few things I would like to share with you.
Please keep the paperwork ready as you might need to assimilate as much info as you can:
1. Educational transcripts - If you have a University in India you might want to contact them now as the Canadian Consulate requires transcripts sealed with the University's stamp. Pull them all together.
2. PCC - If you have had resided in any country for 6 months or more you need to get a Police Clearance. You will have to get your FBI fingerprinting done and it takes a long time. In case you need that, you must always send your fingerprints by a registered system like fedEx, UPS so you can track it. Call them first before sending it: 304-625-5590. I know this sounds a bit too far fetched but I wouldn't want anyone else to go around scrambling for info at the 11th hour. Make sure, you will have to have another PCC if it is any older than 6 months, so you have to have it in good time when you are filing, with all the other papers.
3. Work Experience Ref Letters - If you have had any employers in India you will have to request them to send it, or maybe your wife can help.
4. Bank Statements - Make sure you can show the money required by the consulate in terms of bank deposits, cars etc. Make sure you have the paperwork all ready
In any case you will have to satisfy atleast 1-year of residence in the US so you have plenty of time. So these, and more issues will have to be dealt with.
I know my offer of help seems too far-fetched, but to be honest I am very excited as I have gone through the similar procedure and all the bit wiser that I am now, I would like to help people out.
