Last weekend I had a fender bender in a city parking lot. A desi was backing and hit my car (small dent). He gave his no and left. I had parked illegally, waiting for my family, should'nt have done that. The guy says that this is a no fault case since he was backing in a parking lot. He is decent enough not to mention that I had parked illegally. I haven't talked to my insurance abt this.
Should I get an estimate and split the cost with him or am I am on my own with my insurance? If I take him t court, I know I will lose based on my parking there. There was atleast one desi who saw what happened, a witness.

Parking lot fender benders are a hit-n-miss thing.
Suggest do the following -
Get an estimate of the repairs. Since you were parked illegally, you may have to bite the bullet on this one. Talk to the guy, and let him know the estimate. See if he's willing to reimburse some/all of the cost.
Keep in mind if you plan to go to the insurance with a claim, you have to report it to the collision centre with 72 hrs. Also sometimes the insurance guys ask you a 1000 questions.

I checked with a nearby autobody shop. They say its abt $1k. I need to inform the guy abt this. Not sure if he will pick up any tab. I haven't informed the ins.

If the claim is more than $1K then only you need to go to CRC.
Call the guy and ask whether he is ready to take the tab? If not better go by yourself, calling insurance co will be a waste.
Out of $1000 you need to pay your deductible (I assume $500), $500 insurance co will pay. Then it will be treated as at Fault accident with 50% rating. Your ins premum may go up next year. or atleast noted in your record.
Call your insurance co and ask someone hit your car in the parking lot (you were not there). Check how they will treat it as \" AT FAULT\" or \"0% FAULT\".
Then take informed decision
I had a similar experience recently, though I was not parked. Infact I had just backed out my car and getting ready to drive forward when a sri lankan in a hurry bumped his rear bumper into my front door. He refused to admit his fault and I called the insurance. They said that since we have no witnesses, we have to go 50-50 even though the other persons fault can be pointed out clearly. Now the estimated damage is $1k, how can I go 50-50, with a remark on my driving record and insurance? Surely cannot afford to go solo on a $1k repair. I am still pursuing with insurance for 100% to come from the other guys insurance co. lets see what comes up. Any better suggestions ? The guy left without giving me his contact details. I have already lodged with collision report center.

u know if it is not a big dent, just forget about it and relax. Wait for a big thing to happen and then you can put this along with that and get a claim
