Any suggestions to save PR?

Hi Friends,

Facts:

> Became PR on 3rd Nov 2005 at Toronto with spouse and child.

> Spouse planning to go back to India next month along with child.

My question is if I complete my stay period of 730 days and supposing my spouse and my child do not, can I sponsor them under family category ? or any other way to save their PR?

you need to become a citizen. have them come and stay with you for 6 months at a time. why are you sending them back?

As long as you retain your PR, you can sponsor your spouse and child under family category. However, keep in mind that you will have to pay the all immigration related fees medicals,landing fee etc. again. But if your spouse and child come back to Canada within 3 years after they land, they don't have to go thru the immigration process.

To sponsor, you have to be citizen? Who gives you all this misleading information?

If you meant something else, you worded it wrong.

The Easy way: Do like everyone else does and tell a lie. When your spouse and child reenters Canada they can tell Customs that they were away for only two/three months. Very rarely do the CRA agents check the passport. Canada does not have exit controls , so there is no real proof of date of exit.

The Legally right way: When your spouse and child reenter Canada , tell the truth. They will not be detained/deported. The case will go before an immigration judge. There you can explain the circumstances ("My father was critically ill" etc.) Since you were residing in Canada the whole time the judge is going to rule that your spouse PR is still valid. Go home and be happy.

In case the judge rules that your spouse has lost her PR , you can appeal on humanitarian grounds. The chance that you will lose the case and the appeal is almost zero.

I am not expert in this thing, but don't they have 3 more years to decide if they want to move to Canada or not? I thought you get about 3 years to decide after you became PR.

They become PR recently and I think they have plenty of time to go to India or wherever and come back in a couple of years. I may be wrong here, but decided to write anyway.
