Will the issuance of resident visa invalidate a visit visa ?

Hi,

1) Will the issuance of resident visa invalidate a visit visa which would otherwise be valid ?

2) After landing in Canada and after having applied for PR card, i can go out of the country. But in case if i am called for a picture retake, how could i re-enter after Dec 31' 03?

3) I am planning to stay in Windsor and continue my work near the Detroit area on H1-B. Could i possibly cross the border everyday? Will they swipe my PR card everyday? Is there anyone who has been doing this?

4) I would like to sponsor my parents ASAP, but i would be working in Detroit and staying in Windsor. So, now if i have a good income, how can i easily sponsor my parents to immigrate to Canada? Eventually i will find a job in Canada, but for the next 3 years, i see my self working in USA (Detroit).

1. yes

2. you won't have to apply for PR card. It will be issued [mailed] to you at the address provided by you upon landing. hence, no issues as raised in your question.

3. they MAY document your exit/entry. You can move freely across the border.

4. you need Canadian income to sponsor. However, you can still sponsor knowing full well that the application will be refused. Your only hope will be at the appeal stage. your sponsorship may be allowed on humanitarian & compassionate grounds.

Thanks Massood bhai. A little more specifics on the second question. I understand that the PR card will be mailed to the address i provide upon landing.

But one of my friend was later called for picture retake. He was in Canada fortunately at that time.

As far as my situation is concerned i may not be in Canada ? So now if i am called for a retake then how can i re-enter Canada ? Will that be a problem.

yes it'll be a problem. You will have to convince a visa officer at your embassy that you maintained ties to Canada and that your intention is to settle in Canada etc etc. May be very difficult for you to obtain the 'temp. travel doc'. If denied, you'll have to appeal.

Note: the officer will also take into consideration, humanitarian & compassionate grounds.

That could be a problem and sometimes it happens. I suggest that you carry 2-3 recent immigration photographs with you. Immigration officer will accept them instead of photographing you at the airport and you will not have to worry about a retake. (They can still ask you to report to their office if they want clarification on some documents).

After spending so much time and money on immigration, I think it may be a better idea for you to take a month off and make sure you get your PR card in hand before you go back. If you're in IT (your U.S. H-1 makes me think you are), you can probably work from Canada for that time.

I wouldn't be taking chances with this unless there's abolutely no other way.
