Hi,
I would like to find out about experiences by ex H1 B's who are now settled and working in Canada in travelling to the US.
Can you travel to the US on your H1 visa if still valid even though you no longer work in US (work for same company in Canada).
Have any of you applied for B1/B2 visa at US Consulate in Toronto ? How long after moving is it recommended we apply. Any issues with having applied for labor or I 140's in the past in getting a tourist visa ?
Please advice.
Hi texancanadian,
The answer to your question is no. You cannot travel to the US on an H-1B. Technically, your H-1 is no longer valid once you are off your employer's payroll.
You should not do this even if you can somehow slip through, (by showing old paystubs etc.)
As far as getting a B-1/B-2 at a US consulate in Canada. If you are a PR in Canada getting a B-1/B-2 visa should not be a problem. I don't know what it would be like if you tried it within a week of coming to Canada but give or take a few months and it should not be a problem.
I have a B-1/B-2 and travel frequently to the US without any problems.(I am an 'ex-H1-B')
If you have a pending I-140 approval it might somewhat change the equation when trying to get a B-1/B-2, though I am not sure to what extent.
P.S Miss TX, but Toronto ain't that bad!
