How can you , as an Individual, apply for H1B ???

I was under impression that ... (and I still believe) that H1B is processed by Employers & not Employee (or individuals).

Or is that I missed something in your Post ??? (its possible, as it was lengthy & I am not a good reader :) )

Kiran.

It always was and still is processed by the employers.

Yes! this is my first time application for H1B. Just to elaborate.. the visa application was submitted by a US company and approved. The documents such as LCA, H1B petition etc was sent to me and the process requires that I have my passport stamped for the visa at a local consulate. I am a landed immigrant in Canada and have been here for a year.

I think in the case of first time H-1B applicant they take more time in issuing the visa.

Fingers crossed.

Hi Tammudu,
I am a canadian PR landed in Sept 2001 and within 2weeks time move to USA.For last two yaers I am working in L1 visa stamped in Iindia.
Recently another employer applied for a fresh H1B and got it approved.
My questions are
(1) Can I done my new H1B visa stamping in Toronto?Unfortunately although Apart from SIN,PR card and bank account (with only CDN 100) I don't have any other doc to proof my connection to Canada?
(2)This will be first time H1B visa. Will it take more time to get it stamped?
although I have worked under L1 visa?
(3)If I don't change the employer can I stamp my L1 visa again .My current L1 visa will expire on Mid Dec 2003 but current I94 and L1 petition is valid till oct 2004
Will appreciate your feedback

I am not sure they would allow that. B'cos you got L-1 visa stamped in your passport and you are trying for get H-1B visa. The trick part is H-1B is from different company. They would definitely question your intent there. :(

One more thing:
Do you have any proof of address in Canada? B'cos when you take appointment via web https://www.nvars.com/use/ you need to provide a residential address. Say for Toronto Consulate you have to provide Ontario address. B'cos they post the necessary documents there.

You can renew your visa in US itself.

http://travel.state.gov/hlop.html

The rule is you can apply 2 months before the visa expiration OR within one year of visa expiration.

Hi Tammudu,
I was in process of booking an appointment in Toronto USA consulate.Unfortunately Nov and Dec date already filled up not showing anything on Jan 2004.
Q1:Could you tell me whether USA consulate open appointment only for next two months?Does that mean for Jan 2004 they will open up only in Nov 2003?
Q2: Still appointment is available in Dec in Ottowa consulate .I heard from other guys Ottowa consulate officers little bit flexible. Is it correcct?
Q3:In the reservation initial screen I can always put my current USA address and contact phone muber. Why I need to provide a Ontario address to them?

Regards,
Aniruddha

But if you taking the appointment from outside US, then it shouldn't be a problem. Go ahead and reserve at U.S Embassy in Ottawa. At worst, they transfer your appointment to another office.

Ontario address is required only when you are applying for visa from within Canada.

Read the rules here:
http://www.amcits.com/appointment.asp

http://www.amcits.com/bcc.asp

"And, in certain other very limited circumstances, U.S. visas may be issued by mail with no interview at all. These involve children, persons over the age of 60, landed immigrants who reside in Canada, applications for renewal of a U.S. visa, and diplomats. "
